Big Dog Posted August 1, 2003 Report Share Posted August 1, 2003 I've been in debt validation for a while (6 months) and continue to send letters asking for validation and even have offered token money as payment in full to get this whole issue to go away. Got a mail from A$$et saying that the tradeline would be changed to remove the "disputed" status. Can I get them on anything here, it seems like more of the 'pursuing collection activity when not allowed to do so' type of violation. Does their action here beg more for a lawsuit threat than before? Is it time to threaten to sue for defamation and for the whole attempt to collect without validation in the first place? It's a pain to have to learn what to do and file suit, but I want to get this stuff gone. Good faith on my part has been given, and now I'm getting to the point where I want to know if they're ripe for a suit against them.--Big Dog Link to comment Share on other sites More sharing options...

Big Dog Posted August 5, 2003 Author Report Share Posted August 5, 2003 AAC thinks that they are off the hook with the computer printout, but the FTC opinion by (forgot the name, Wollman I think) has stated that a computer printout is not validation of a debt. All that AAC has ever sent was the printout (they've sent it about 4 times). There has never been a single document showing their legal right to collect the debt (or that they even bought it), nor a signature card showing the original account agreement, no statements or accounting for how the current value they say is owed was calculated (how can they collect if they can't document the math that was used to arrive at the current balance), etc. They are so close to getting sued by us for the whole thing, but I'm getting my ducks in a row first. sisflomi Posted August 5, 2003 Report Share Posted August 5, 2003 Well, they are pretty brave, thats for sure. They sent a garnisment through to my bf's work after they were notified of his bk stay.
