I have sent them 3 validation letters this past Tues an Intent to Sue Letter. I just noticed today that they are now reporting this item in dispute with EXP under the FCBA-Fair Credit Billing Act after 3 letters. All my validation letters were focused on the FDCPA and hinted at violations of the FCBA. Does it matter what ACT they list as being disputed? This has not been listed in dispute on TU, is this normal? I will not be able to sue them until after Turkey Day. Will this effect any leverage I have? This one took over 40 days to put this in dispute, and this was only with EXP. They just verified with TU and there is no dispute listing with TU. Anonymous Posted November 23, 2002 Author Report Share Posted November 23, 2002 I talked to Equifax toaday and asked them how having the collection agency report that the account was disputed affected my score. They referred me to their people at their credit watch department. The agent there said that if the collection agency or creditor reports that it is disputed, that acoount is not used in the credit scoring. Niner849 Posted July 1, 2003 Report Share Posted July 1, 2003 I had an account with them. They deleted from my EXP, shortly after receiving my first DV letter. I sent them a second one, and they have until the 9th to respond to that. Then I'll send the Estopell to them. I've heard rumors that TU's computer can't handle placing an item in dispute. I believe this is true. I'm surprised they even put the account in dispute with you, they haven't even done that. What address are you using? I have an address for them here in Torrance, Ca.
