toughluck
First, Great Board!!I have a question about a dispute with TU. I filed for ch. 7 in 11/92. TU is the only one that reported it on a J.C. Penney acct. I tried to have it removed after 7 years and was told I have to wait 10. Well, it's been more than 10 and after I filed a dispute, TU sent a letter requiring more info. They want copies of discharge papers plus a list or schedule of creditors included. Shouldn't the disgharge be enough for them, or do I have to pay the $35 (to the federal court) to get them a schedule?
Anonymous
try calling them on the phone. they should take this off, it very obvious it's been 10 years, if they won't, quote the law via mail. good luck
crofttk
That's their responsibility ! The public record can only stay 10 years. Any negative account, including one from bankruptcy can only stay 7 years. See what dates they show on these entries. If the dates ate correct tell them they should have been deleted long ago. If the dates are incorrect, tell them the entries are incorrect and let THEM go to the expense of investigating them. If they come back and say they've been verified then they full of c--p and you can start building a big case against them ! I'm not a pro or a vet, just someone 6 yrs. out of BK7 and keenly interested. Others are free to critique what I said ! (I'didn't need to say that did I ?)Good Luck !
