kb9tbq
Judgments stay on the credit report 7 years from the file date. If they are paid; satisfied; or discharged the credit report will only be updated to reflect this. If the judgment is dismissed; then it gets removed from the credit report. Go to the court house and review the judgment for yourself. How were you served notice to appear in court? What state are you in (each state as different statute of limitations) on how long debt can be collected on.You may try to dispute with the CRA (to see if by some technicallity you can get this removed). Most people start out "no knowledge of having judgment".

smogtek
kb9,What happens in the case of a judgment that is not filed until, say, 2 years after the date it was granted?Doesn't seem fair that a judgment creditor can hold a default judgment for an indefinite period of time then file it so it ends up on your report later down the road. Anonymous
Smogtek----Usually in the case of a judgement, the Plaintiff has to file a Journal Entry of Judgement. This is signed and/or stamped by the Judge (Clerk). Typically these are done ON the court date and are dated.Check with the Court Clerk, see if there is a Journal Entry (JE) filed (AND STAMPED BY THE COURT WITH DATE). If so, get a copy and forward to CBR's. If not, there is technically no Judgement.ex:ABC CollectionsPlaintiffvs SC-01-1256Joe PublicDefendantComes now this ____ day of _____, 20_______.Plaintiff did/did not appear in court in referenced to the above styled cause.Plaintiff is/ is not entitled to judgement in the above styled cause in the amount of ________ Plus Court Cost and Attorney Fees of ____________ and any Interest accruing at the rate of ____ % per annum from __________, 20 _____.Dated this the _____ day of _____, 20____.___________________ ________________Plaintiff JudgeAddress & PhoneRobertP.S. -- The Plaintiff is Supposed to mail you a copy of the JE.[Edit by robert0826 on Tuesday, April 29, 2003 @ 07:06 PM] [Edit by robert0826 on Tuesday, April 29, 2003 @ 07:07 PM]
Anonymous
OK -Maybe some States do not require Journal Entry of Judgement but EVERY Court Clerk will have the date suit was filed, Proof of Service, Continuances/ Alias' etc......They will also have the date Judgement was RENDERED.If, this differs from dates on CBR's, either dispute with CBR's or Get printout from Court Clerk and forward to CBR's.Robert
