utman17 Posted May 29, 2003 Author Report Share Posted May 29, 2003 Yes collection agency, they have verified it 3 times on EQ and EX, but Trans deleted it..they sent a offer to DW for 20% of total owed, but we havent responded yet..she has that and one Collection for 66.00 that im also working on.. it has been deleted on 2 of the 3 on the first try.. lisak72 Posted May 29, 2003 Report Share Posted May 29, 2003 If you know for sure that your SOL are up, quote your state laws telling them that too. It doesn't mean they can't collect, just means they can't sue you for it. Basically, send the DV in CMRRR....make sure to get the signature with these! And wait...I always tell them in the letter that if they are unable to validate this with me, they need to quit reporting it to the CRA and delete any entries on my reports. If they do not reply, then there is a sample letter above to send to the CRA telling them they were unable to validate this debt with copies of the green card and letter you sent to CA...they should remove the listing with this proof that they didn't validate with you. I called them started quoting FDCPA, FCRA, FTC. I scared them, and he didn't verify/validate the dispute. Turns out he had verified with experian. 15 days prior.So, that gave me the idea of scaring these guys, and then disputing.I did a google search today on "FDCPA violations" and I found some articles of CA's that got sued big time. It really motivated me to learn this stuff and gave me more confidence when talking to the CA'S.... Anyhow, what you do, if you are going to do it CMRR style, as soon as you get your reciept in the mail, you do another dispute to the CRA.... If they don't drop it in these next 30 days, I would send another more intense DV letter to scare them and dispute again???... sorry it took so long to respond, gotta learn to respond in one sentence, Morrow is the champ at that(lol) Link to comment Share on other sites More sharing options...
