Consumer Lawsuits

The Act makes it easier for purchasers to sue for breach of warranty by making breach of warranty a violation of federal law, and by allowing consumers to recover court costs and reasonable attorneys` fees. This means that if you lose a lawsuit for breach of either a written or an implied warranty, you may have to pay the customer`s costs for bringing the suit, including lawyer`s fees. Because of the stringent federal jurisdictional requirements under the Act, most Magnuson-Moss lawsuits are brought in state court. However, major cases involving many consumers can be brought in federal court as class action suits under the Act.

Although the consumer lawsuit provisions may have little effect on your warranty or your business, they are important to remember if you are involved in warranty disputes.

I'm working a way to get the debt to the OC and arguing this point. It's always pretty easy to get the OC on something not working right.

I want to use it on my CELL PHONE service, it is so crappy!!!!

You know what Qwest told ME???????

I didn't pay the bill, I was moving, they shut the service off. this was 2 months ago. HOWEVER, they told me, and this makes sense if you think about it, that once it was shut off for non pay THEY violated the contract just by shutting off the service, and when I paid it all off I simply requested for the contract that THEY breached NOT to be reinstated, in fact I requested it on the phone AND wrote it on the check :)

However, had I paid everything off then asked to get out of the contract I would have had to pay an early termination fee.

That's a cool way to get out of a termination fee. Did they put it on your CR?????????

Hey, how could I use this to bring my cell phone bill down, I went over 250minutes in APRIL, when I first started cleaning up report(don't laugh).

... The phone was warrbolling(sp????) like crazy, I didn't have time to take to the service center, but it did slow down communications, I'm disputing the bill on the 60days thing but I want them to knock off 150 minutes??????

Yes, you can check usage, but I was so dammed determined to fix my credit, and get up to speed on CRA'S, FCRA, that I didn't check the usage.

... And you don't get a message on the phone.
