Where the hell is cookimonster so I could tell her the news?

So for those of you who remember a certain CA that I was dealing with (the jerk offs who sent me the cease and desist letter). I got a letter today from them stating that my judgement has been filed as satisfied. :D (they previously werent updating the collection and its been listed for 2 months as unpaid, when its paid already!)

I guess Im happy. But seein how the judgement wasnt on my CR in the first place...whatever!

Now the collection that is on my CR is updated with a $0 bal so yeah! I guess you could say im happy-er! I'll get there though!

Congrats, morrow! Good way to start the weekend! I'm having my own problems with Chase (see separate thread) not updating my account as paid, $0 balance. Trying to figure out if I have an action against them under the FCRA since they keep reporting incorrectly, even when I called them directly to advise them of their mistake. Very frustrating!

Yes as a matter of fact I did, funny huh!

I started off sending them a DV letter. Then a second, then an ITS, then not one, not two, but THREE nutcase letters! I guess I just pissed them off and they were getting sick of me!

Heres the thread if you care to read! Its long:

I got a judgement against me and then they got a writ of garnishment. I got the judgement about a year or two ago and to be honest, I had NO clue what the heck that meant or even what I was supposed to do. So I just ignored it.

Next thing ya know I went to my bank to deposit some $$, come to find out the $900 that I deposited the day before was GONE!! I talked to the gals at the bank and they said that I had a withdrawl from a levy (?). And it was that c*ck suckin CA!!!!!

I was livid!! I called up the CA to give them a piece of my mind and asked WTF?? Why did you do this? (if you read that thread you could see that I tried MANY times to make payment arrangements, but they sent them back to me). Well, I let it pass and in March the same CA pulled the same crap!! Taking out the remaining $500 that they didnt get the first time!

This whole ordeal was really shitty and Im glad its finally over.

That makes me so f!!!!!! mad.

So, they have to send you a 'writ of garnissment' first, and you have a choice of what to do??? Or is that it!!!!

Honestly, dealing with this kinda stuff is not my specialty!!

Im good at alot of things but when it comes to legal crap....im an idiot!! Seriously.

If you look on that thread I posted, cookie and I discussed the steps they took to get the big "G", I cant remember off the top of my head and Im too lazy to go back and check!

Like I said, legal crap is not my strong point! But hey, if you ever need any sample letters or help with inq or other procedures, I GOT YOUR BACK!!

Kb9tbq is good for gettin the inside scoop on the CRAs and thier procedures.

Swede knows alot about the laws and legal stuff (plus she keeps everyone in check) :D

Everyone has thier strenghths and weakness here, but we all play for the same team!

I can tell you this, with a garnishment, they don't have to notify you, why would they? They wouldn't, cause then you will go run and get all your money out. Like I did!!!!!!!! They got, sorry no funds letter from my bank. I call the court every couple of weeks and ask for info, they tell me if there is a new garnishment in place or not. Seems come creditors are just stupid enough to get the "big g" and not act on it right away. Next thing, the bank has to hold your money, they call it freeze, I think its 14 days and send you a letter letting you know about it. When you get that letter, thats your chance to go to court and ask to have a stop on the garnisment. I forget the legal name of it. In my case, I get child support and unemployemnt and that money my friends is totally exempt from the "big g". Of course, you would have to prove thats where the money came from!!!!! I don't know how it is with other states, but here in MI the garnisment states on the back that they can not touch the first 500.00 in the account. Only good thing about MI laws, at least they are making sure we can still feed the kids for a couple of weeks. Also, if you have a judgment against you, and you really have not got a lot of money, you can ask the court to allow installment payments. I am not sure if it will stop garnish or not, but it will make it legal for you to make payments on the judegment. Hope this helped someone.

Oh, MORROW, sorry, I forgot about ya, congrats on getting the zero bal. Don't be so "happy" as you say you are. I read between the lines!!!!!!!! You can always fight this one again. They are gonna get tired of it sooner or later, and as long as you are only disputing the cra's, then you have ceased with the ca right????????? Hey, its still one foot forward this time, and no steps back!!!!!!

They didnt notify me before they took it out, they told me afterwords though! (how f*ckin considerate of them)

Yes, had I known about it, I would have closed my account.

I was going to claim an exemption for the funds due to some of it being from unemployment (laid off) but it would just take too long and since they already had taken the money out of my account I just said F*ck it! Its paid! (what a potty mouth I am :) )

I agree, I feel the same about bf's child support. They took his taxes, and it all goes to the state not the mother or the child, so it ticks me that the kid never benifited from it. It was nothing we really missed, and knocked the back pay down a few thousand. I am ready to just pay my judement too, all principles and morals thrown out on this one. I am tired of not being able to save our money and earn interest. If they had gotten my money, it would have totally satisfied the 4800 stupid thing and be off my back now. I was just too stub to let them have it!!!!!!!!! But we just blew this money away cause it was cash sitting here that was easy to get to. You are right in that its paid and done with. I went today to meijers and paid a bounced check that was under a 100.00 from a year ago, it cost me 138.00. Feels good to have it off and now I can really mess with the CA!!!!!!!! CA told me meijers would never let me pay them, and ca started to taint my report!!!!!
