Been lurking, wanna share results

Ok! First off I have been lurking a bit. THANKS!! for all the good info. I started this Journey 10 April 03. (Got my first credit report and decided to do it!)

So here is my progress so far:

TU:17 del

EX:8 del

EQ:8 del

Things are bumping along ok..

BUT today I checked and a CA account that I had deleted is now showing up, but get this, it shows as the doctors office!!! I am a women and it is a gyno.. Just a little embarassing. :mad: (I have the UDF from the CA as it was never supposed to be there and I got the DR office involved)

So what can I/should I do now? :confused:

Well, first, is this a paid medical bill?

If it is paid, I believe you'll have some leverage with HIPPA laws, but I only have a weak understanding of that. I think paid medical bills cannot be listed due to privacy laws.

I'll defer to a better educated opinion then mine for the details.

BTW- Great job on the deletions so far!

Wonderful results - you are definately off and running with this. ;)

Forward copy of that UDF form to the CRAs - requesting that they remove the tradeline off of your credit report. This one should be simple enough for them to get done right this time around.

If it is the actual doctor's office that placed the listing there then that is a violation. A doctor, utility, etc. can not place information on your credit reports. They can send the bill to collections and they can.

UDF (Universal Data Form) this is a one time update - best used to show accounts paid in full or for deleting tradelines.

Not good for updates on open accounts with existing balances; the tapes need to be updated - so that the changes don't revert back to what the tape showed originally.

TransUnion & Equifax use these; Experian can in rare circumstances - but they are using a different system now for the most part.

Is this true? A utility company can't place information on reports? My DH has a listing for a Gas company. It's listed by them, and then it's also listed with a collection agency. What do we do?

No utility companies can now report and have been doing so over a year now.

The rules state that if they are going to report as an original creditor they have to report all customers positive or negative.

Collection agencies are the only ones that can solely report negative accounts.

Does this mean I can dispute the electric co. derog and get it off? They have not updated since 99 and SOL runs out this month so I was holding off. If they cannot report at all though, then I can get them right there even if they do verify. THanks!

Can you direct me to a site that has the info on where a utility could not in the past report to a CRA? I knew this was in the books somewhere because when I use to work as a customer service rep for a phone company years ago, I was told by one of our collections people to not let customers know that if they didn't pay their bill, we could not report to any CRA. Now the reason I'm asking is that I have a collections on my Experian report that doesn't belong to me and if I can get it off with the old law, I'd like to take care of it now rather then wait another 15 days.

Thanks for the replies. The entry on my TU now is listed as the doctors office (PG shows this) I am going to buy my TU report tonight to be sure. If it is the DR office showing, what do I do?

I have the form that the DR.s office made the CA give me showing that they requested deletion (a UDF) and it came off all 3 reports, it is just now on TU as the dr.s office. So I guess I am asking what my next course of action is?

Honestly I don't know where it would be in writing, but working for a credit bureau here - it is my understanding that we can't set up anyone for reporting just derogitory information if they are not a collection agency solely.

Medical Providers

Utilities

Landlords

All want into this side of things, but they can't solely report negative as an origianl creditor unless they have over 100 customers by TransUnion / Equifax standards and can send in tapes on a regular basis. Experian requires 500 customers included on the tapes.

Even the smallest of collection agencies can get crunched on the requirements, if they don't hold more then 100 - 500 accounts. They also need to meet the format requirements weather they report themselves or use a processor.

Now if a doctor or utility could not meet this, that was easy to get around by filing a judgment and hiring a collection agency to collect. The collection agency would then report on their behalf. I don't know when this changed though, I have only been on this side of things for 2 years now. Not really sure it was law, just that the CRAs changed their policy.
