i know you frequent this forum, so i wanted you to check a thread you created on may 1 in 'beginning debt validation' i posted a reply and i was wondering if you wanted to share what you learned based on your question... it's called 'newbie debt validation question or something...

#1) I guess your saying that you already paid right?

#2) Anyhow you already DV'ed them right?

#3) And they didn't send you a signed contract right!

#4) Well, there are several appropriate responses here.

... FIRST OF ALL , DON'T TELL THEM YOU ALREADY PAID(YET),

.. You can send them a 2nd DV stating that printout is not valid validation and some case letters, then tell them to produce a written contract with all the fees itemized that clearly shows your are "OBLIGATED" to pay these fees, and CC it to the FTC. In your letter you might want to state that under FDCPA that it is illegal to collect a debt that you are not 'OBLIGATED TO PAY" and therefore you are requesting full validation:

HERE IS YOUR RIGHT TO REQUEST THAT YOU ARE OBLIGATED TO PAY A DEBT

§ 808. Unfair practices [15 USC 1692f]

A debt collector may not use unfair or unconscionable means to collect or attempt to collect any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:

(1) The collection of any amount (including any interest, fee, charge, or expense incidental to the principal obligation) unless such amount is expressly authorized by the agreement creating the debt or permitted by law.

and a DEBT is defined as:

(5) The term "debt" means any obligation or alleged obligation of a consumer to pay money arising out of a transaction in which the money, property, insurance or services which are the subject of the transaction are primarily for personal, family, or household purposes, whether or not such obligation has been reduced to judgment.

So, basically, it is illegal for them to collect a debt which they can't prove you are obligated to pay. The letter should basically state that they haven't provided enough proof that you are obligated to pay and there is case letters that a print out is not enough!!

okay sorry, i didn't quite expect you to address my concerns (as thankful as i am that you have...)

but here is the thing

*hospital bill (unpaid 4 year old collection with partial payment)balance being 2,000.... DELETED.... ignored request for validation... so my question here was 'what does the cra request for validation, why didn't these people validate? weird. can they come up with whatever was requested and try to put it back on even though the 30 days are up? i just can't seem to grasp the fortunate circumstances here... plus they are calling my home... so i just think it's fishy'

*dr bills... verified by cra...but only partial validation from CA.. i go into further detail in my 'green cards? what's the point if cra's don't care' what i am gathering here is that the cra doesn' need a contract for verification, but that d/v is for cornering ca independent of cra... so i answered my own question i think....

BUT basically, what i was wondering is 'what happened with your situation?' were you able to obtain a contract? if so, what did you do with it?

I'm not sure who you are compatible with, I would have to check that, but I was refering to the way you process info. I know several Picess people, they have a hard time staying focused because they go by mood and bodylanguage. Anyhow, It helps knowing a person's temperment to understand how to present information to them!!!

so if you are into astrology, you have to tell me what a pisces is compatible with? whats funny about what you described is that i manage the event planners/coordinators at my company and i am sooo fricked unorganized i don't know how i make it. i have one little book that i write everything in and that is the only way i can get anything remembered or filed...it's nuts not only do i have to deal with their crazy details, but my own too. i more of a 'big idea' person rather than someone able to handle ALL of the details. isnt it amazing how we learn these things about ourselves...by getting the job we think we want... i was so much more successful in sales i think.

Well, we might have to carry this conversation out in the lounge area, but I'm a pretty good student of human nature and there are some basic temperment types, once you know that you can pretty much figure out what people are going to do.

I do people's astrological charts and usually, I'm 60%-80% on the money. I've even changed peoples lives and turned around some business with it, it all pretty simple stuff after a while and its not as scary as it sounds.

I have a brother who is a Piceses and he used-to drive us crazy, because we never knew if he was comming or going but he is very good with people and he is very successful. He basically, cues off of people's mood and knows when to say the right things. He has a concentration problem. It's all pretty basic!!!

Pisces are supposed to be compatible with Cancer and Scorpio...however, I'm a Cancer and my ex-hubby was a Pisces and that didn't work AT ALL! I think if I were the Pisces and HE had been the Cancer or Scorpio, it would have worked out a little better, but a flighty man does no good with a female Cancer with a rising sign of Scorpio! I was definitely the more dominant...heehee!
