Anonymous Posted June 23, 2003 Report Share Posted June 23, 2003 Same CA as I was talking about before out in Washington... they're adding a lot of fees and interest to an account that's been reduced to a judgement, which I'm sure is a violation, though I haven't seen anyone post any statutes regarding that.. HOWEVER.I just checked PG today.. I had sent these guys a DV. They have the accounts marked as "in dispute". They have not validated the debt with me...and they just added 2 more dollars to the balance "owed" on the account. I thought once the account was listed as in validation/in dispute/whatever the CA reports it to the CA as, that they couldn't do anything with the debt until it was validated? I understand that it's not going to fall off my CR until the 30 days expires, but them updating the balance like that...that's continued reporting of a debt while in validation, isn't it? If you sent them a DV letter requesting FULL VALIDATION, you might have them on:FDCPA: SECTION 8 , FALSE OR MISLEADING REPRESENTATION:(8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.
