What are they reporting on your credit report?

2. Have you disputed as 'not mine' yet to the CRA????

3. Have you contacted the CA

No not on Chexsystems. Have disputed with CRA and they have validated. Also sent DV letter and they send me back copies of the four checks. I know the debt is mine but, if I pay them can I request they remove it from my credit report as part of the settlement before I pay them?

Well you are in danger of being on CHEXSYSTEMS which is a real pain.

If I were in you position I would do the following, of course there are other experienced members here who would take a different approach, I'm sure they will offer their advice too.

But, this is what I would do base on my skill set:

#1. I would get a savings account with ATM access and an extra Checking account first, shop around for an account with a low fee.

#2. There are several ways to fight valid collection, remember sometimes it not whether the bill is valid its HOW they collect it. Not trying to preach, but it's like anything else, "its not what you do but HOW you do it". Alot of collection agencies and lawyers have gottensued by braking the rules when collecting, .... with that in mind here are some common collection violations by CA'S

1. they may not be able to collect in your state

2. statue of limitations my have past

3. the totals reported to your CR may be wrong, you might be able to convince them that they violated

4. they may have harrassed you

5. The all time classic DUAL validation, if they don't put you account in dispute you might get them a violation, you said that you already DVed them, they the mark it in dispute, if not print a copy of your CR. ...I'm not sure how the senior members prove in court that the account was not marked in dispute, you might ask?

6. they may have violated your mini-marands

7. if your phone bill keeps records with times they call, they may have called you after/before hours

8.

.... I'm sure other members could add to the list.
