Another way, would be to contact the OC, point out to them that you paid this with them, and since the matter is settled they need to retract the collection agnecy since they where never involved with the matter.

Should they agree to re-track then get letter confirming this, and forward copy to the CA requesting that they follow the bidding of the OC and remove trade form your credit report.

Then have them forward you a confirmation as well, so that you can forward to the CRAs requesting removal. Make sure that this is on their company letterhead & signed.

* Now the bad news, some OC's have contracts with CAs that state should a consumer try & settle with the OC they are to either 1) Direct the consumer directly to the CA in the matters or 2) Forward money collected for processing (meaning that the collection agency - gets to retain the right to continue reporting)!!!

More & more CAs are seeing to this matter - to protect their rights to profit from the account being asigned to them in the first place - cause it was too easy for the OC to keep the profits and never tell the CA of the matter.

So this will be one or the other for you, just have to call the OC follow this to see what may come of the matter.

It just occured to me: If the OC and CA had an agreement between themselves, and I paid the OC, I shouldn't be affected by it and have the COLLECTION show up on my report?

Oh, sry - thought you ment you paid OC but that the CA was piad & on the credit report.

Please forgive me, my cold is taking its toll. Well that would be a great way to go if you had collection agnecy reporting.

With the OC you definitley have a whole other problem, which I can't even give you a good answer for. There are just trial & error - spam disputing and hoping for the best that at some point someone will drop the ball allowing for the tradeline to get deleted,

There are no other answers for this problem - just persistance is going to help you on this matter sry to say.

I was thinking about this since I logged off earlier today. Now, I know why when you call some CA'S they say they can't negotiate because they are bounded by the OC. I guess what they are saying is that they have a CONTRACT with the OC and they can't break it otherwise it would be BREACH of contract between the OC and the CA. .... But, If the OC accepted my payment, the CA has no legal right to report on my CR since I never made a payment( a CONTRACTUAL OBLIGATION) with the CA. .... in other words if the CA and the OC have a contract , that is between them, I should not be affected by that????? :? :? :?

I really don't know on this argument - that is very ify - and I just don't know the answer to this.

I thought about all the questions that you ask on a regular basis - and just thought of a great place to direct you to where you can ask away all the collection agency related questions you want to get your answers.

www.collectionindustry.com

Enjoy :)

Thanks KB,

I know I ask a lot of questions, I do appreciate everybody's help, and I always try to share my results with the members so we can all benefit from each others success's and stay away from the failures. I have a tendency to express my opinions and I'm always looking for new ways to do things, I get frustrated with the debt collectors and creditors, they seem to always be looking for new ways to get every penny out of consumers. .... sometimes asking questions get me in trouble!!! I don't mean anything by it. ..... I'm trying to stay ahead, and get ahead of the OC's/CA's. ~_~ ~_~ ~_~ ~_~

... I know we can beat these CA'S/OC'S :) :) :)

Remember when you go to this site, you will be moving around people who are a part of the collection industry - this site is specifically set up for them to share information & experiences of the trade.

They definitely reference various laws alot so just sitting in there & reading will definitely enlighten you.

Be mindful that there are some very agressive members that are to say the least are not consumer friendly what so ever and have a chip on their shoulder. So tread carefully shoud you post to ask questions.

But, there are others whom will take you up on discussing these things - like me sitting here working with a credit bureau and discussing my trade that appriciate the means of educating and not fighting.

One other thing; no one side has the absolute truth, it is mixed amoungst all sides in bits and pieces.
