You need to take this question to the legal section and look for Calawyer or even LadynRed - they can help you much better on these matters.

Best of wishes - you should be fine if you can show the court the fact of the matter in this situation I believe - just that you will need better guidance then what I know of for this part.

Uh oh......I know how it feels...I got nailed last Oct (CA for Sears) and I had a judgement against me. MY ADVICE?? Get your head out of the sand and strike a deal with them. I fought the garnishment with the reason: "head of household" (which I am) but they fought me and rather than go head to head in court (I sure wish I had known about this board then...cause I wouldn't have ignored it...I would have known to validate) I gave in and agreed to payments (what choice did I have? They garnished my wages and BELIEVE ME...they were getting a BIG CHUNK of my paycheck). THIS WILL NOT GO AWAY......have your wages already been garnished?
