Ainzboogie
Hi everyone, I need to know if anyone has had any sucess with settling with Providian. I've heard some horror stories regarding them but need to know as I have a $4000.00 debt with them that I would like to settle for half that amount. I'm trying to get this cleared up so I can apply for a mortage for my first house. Any help in this would be great.
sisflomi
When was the last time you made a payment to them? What is the status of the card now?
Ainzboogie
It's been so long that I think the last payment I made was in December of 2001. Also, a CA has this account now but it's not showing up on my credit report. So what I would like to do is go back to Providian but want to know what are the odds of them settling. sisflomi
What state are you in? I think prov prob sold the account by now. There are some that were able to settle with them. Have to look back through some old posts and find them.

sisflomi
Do you know for sure how you aquired the card? Did you apply over the phone or the internet? Did you send in an application? This is important, it will decide just when your sol is up.
Ainzboogie
It was done over the phone in Aug/Sept of 1999.
sisflomi
I think that would fall under the California sol of two years. Let me check on that and get back to you. If its past sol, you got them right where you want them. Did you opt-out your name yet? From pre approved mailings?
Ainzboogie
I did opt out on the pre-approved mailings list two days ago. Thanks for your help on this.
sisflomi
Ok, no problem. Glad you already got that far. Here is the section that I am talking about.339. Within two years: 1. An action upon a contract, obligation orliability not founded upon an instrument of writing, except asprovided in Section 2725 of the Commercial Code or subdivision 2 ofSection 337 of this code; or an action founded upon a contract, obligation or liability, evidenced by a certificate, or abstract orguaranty of title of real property, or by a policy of titleinsurance; provided, that the cause of action upon a contract, obligation or liability evidenced by a certificate, or abstract orguaranty of title of real property or policy of title insurance shallnot be deemed to have accrued until the discovery of the loss ordamage suffered by the aggrieved party thereunder. You need to know the correct date that you last paid to providian without any late fees or anything else neg on it. Last good payment to them. If it was Dec 01 like you said above, the sol would be out this december. If you lay low on this for a couple of months you won't have much to worry about. CALI is great on consumers and debt.
Ainzboogie
that's good information to know. But how would I go about finding out the last good payment I made with them. I don't have any statements from them anymore. Plus, I don't know if I want to wake up a sleeping giant by requesting it from them unless they are legally obligated to provide that information to me. sisflomi
Do you happen to have an old report from EXPERIAN with it listed on there after it went bad?

md
If you are trying to settle don't tell them that you want to get this done for a mortgage you would like to get.
Ainzboogie
I think what I'm going to do is send in a validation letter first as I want it off of my credit report. Plus I just got a letter today from a ca which I will be sending over tomorrow a validation letter as well.
