Providian Settlements

Hi everyone, I need to know if anyone has had any sucess with settling with Providian. I've heard some horror stories regarding them but need to know as I have a $4000.00 debt with them that I would like to settle for half that amount. I'm trying to get this cleared up so I can apply for a mortage for my first house. Any help in this would be great.

It's been so long that I think the last payment I made was in December of 2001. Also, a CA has this account now but it's not showing up on my credit report. So what I would like to do is go back to Providian but want to know what are the odds of them settling.

Ok, no problem. Glad you already got that far.

Here is the section that I am talking about.

339. Within two years: 1. An action upon a contract, obligation or

liability not founded upon an instrument of writing, except as

provided in Section 2725 of the Commercial Code or subdivision 2 of

Section 337 of this code; or an action founded upon a contract,

obligation or liability, evidenced by a certificate, or abstract or

guaranty of title of real property, or by a policy of title

insurance; provided, that the cause of action upon a contract,

obligation or liability evidenced by a certificate, or abstract or

guaranty of title of real property or policy of title insurance shall

not be deemed to have accrued until the discovery of the loss or

damage suffered by the aggrieved party thereunder.

You need to know the correct date that you last paid to providian without any late fees or anything else neg on it. Last good payment to them. If it was Dec 01 like you said above, the sol would be out this december. If you lay low on this for a couple of months you won't have much to worry about. CALI is great on consumers and debt.

that's good information to know. But how would I go about finding out the last good payment I made with them. I don't have any statements from them anymore. Plus, I don't know if I want to wake up a sleeping giant by requesting it from them unless they are legally obligated to provide that information to me.
