I'm still trying every angle I can with Chadwick's to get an item off my Credit Report. I'm now sending a letter to their Credit/Collections VP.I've told this story a lot on the board already. Basically bought some stuff on their deferred billing, it was to be charged to my CC after 3 months. They didn't do so, and didn't notify me of an outstanding balance. Placed it for collection and put on my CR. No collection notice. Internal collection dept. I paid it when I found. (only $39) They won't remove, I've been around in circles with them and the BBB.So, I'm wondering if I can get them on the FCBA? They have reported the account as an "individual, unsecured". Would the area under FCBA where it states they must "send a statement for any billing period which the balance owed exceeds one dollar" apply? They obviously didn't do so!Thanks for your help! sisflomi Posted August 8, 2003 Report Share Posted August 8, 2003 The problem with using FCBA is that you only have I believe 60 days to dispute the billing error. And those #$^"(#*'s keep validating!!!I was going to write a letter to their VP of Collections/Credit, his name is posted on the BBB because they have a history of screwing people. They were on the top 10 of most complained about businesses. I was hoping to cite something "official" in my letter to him. I could try the DV method, but I've written so many letters already they've probably got everything together on my account! My thought is until it was charged to MY credit card (a visa completely unrelated to Chadwicks) that it is considered to be THEIR account for that 3 months? The problem was that I had purchased about $500 worth of clothing - a lot of it was returned and on back order and such. So there was much confusion in the credits/charges I was to receive upon the completion of the deferred billing cycle. I didn't realize there was a $39 straggler that they never charged to my visa. They don't even know why it wasn't charged to it. At least if they would have said that my CC company rejected it for some reason - I could contact them and find out why. It appears that Chadwick's just *f'd* up and they don't want to admit it - and just ruin my credit in the process. No bill, no statement - no notice. Just found it on my CR a year later.They have an internal credit department for deferred billing. I don't know about the company for their CC. As a sidenote, I have a Household credit card and they have been wonderful!!! So I guess it goes to show that everyone's experiences are different.......My thought, that even though I'm past the 60 day window for the FCBA - I can claim ignorance that I didn't know it was my right to receive a statement due to the fact that I had a balance with them.
