tyraid Posted August 8, 2003 Report Share Posted August 8, 2003 I was just thinking about the summons that I was served almost two weeks ago now. The Complaint states the debt is one amount, but in the sworn affidavit it says I owe less. Now the very last page of the packet of paper work states that I have 30 days to dispute this debt or any part of it. Now if I send a dispute letter out tomorrow, the lawyer will get it on Tues and my court date is Weds. Would he then not be able to attempt to collect the debt because it is in dispute? I have already sent one dispute letter which my requests where partially fulfilled. Thoughts? I was thinking that if I show and the lawyer doesnt, then I could possibly win the case because the lawyer would not show. Please anything that anyone has to say would be great. I live in IL. I have not had a chance to really dig in on what she found, but I don't think it looks very promissing. Will have to check it over this weekend when I have more time.
