Lizzy
Account in dispute under Fair Credit Billing Act It reads that under STATUS. What the heck does that mean? It came back verified and the OC sent me a letter to write them and tell them what my dispute was. I ignored the letter and my results came back verified. Any insight? kb9tbq
They are covering their bases, this is what they are suppose to do when a consumer disputes. This will remain until dispute is resolved. I am not sure what you do after this point, if you can still dispute again on this matter. What is the reporting with this particular company? Lizzy
It is a charge off for 243.00. I have no CA calling me or writing me about it. I almost want to pay it off to get it updated to paid. I am not sure what to do at this point. Liz
kb9tbq
No collection agency reporting on this one? This is the perfect chance to see if you can't negotiate with the OC directly on this matter. See if they will remove for payment, or update paid as agreed, though that can be a far stretch sometimes to accomplish.Wonder if you might be able to ask for re-aging even though it is past charge off status. Even good will letter, never know until you try, and don't think it should hurt anything to try.
jam
The Fair Credit Billing Act, is the third law that can pop up, but gets covered less than the other two...Basically, if you've looked at your bank statement, credit card statement, etc, and saw the you have 60 days to advise us of a billing problem, that is the FCBA rights advisory statement.15 USC Sec. 1601 - Consumer Protection Act(The 1974 admendment to the Consumer Protection Act, is the Fair Credit Billing Act.)Sec. 1666. is the section regarding billing errors.http://uscode.house.gov/uscode-cgi/fastweb.exe?getdoc+uscview+t13t16+1782+3++%28%27Fair%20Credit%20Billing%20Act%27%29%20%20%20%20%20%20%20%20%20%20This is why they were asking you to explain the nature of the dispute.I was trying to find a comparable page to the FTC's hub for the FCRA, and FDCPA, but wasn't able to find one, yet...
