I paid it almost 2 years ago, about 5 months ago I requested validation for it because the CA did not delete. They ignored me and I must've sent them at least 4 validation letters. My last one was received by them on 6/16, I gave them 15 days. Since I did not hear from them, I sent a letter to the OC, last week, stating that my privacy is being invaded by having this collection on my report. The dr. is specializes in female probs so any potential creditor, employer etc. can look up his name and pretty much figure out why I went there, I feel this is a major invasion of privacy and thought the dr. would delete based on that. Well, just today, I received a print out of charges (no ss#, no signature) from the CA which was supplied by the OC via fax on 8/7, a day after I sent the OC the letter. I don't know if the dr. has received my letter requesting him to delete it yet because there is no record of it showing up on usps.com. So either the dr. recieved it and provided the printout to the CA or it's just a coincidence. Now, since the dr. sent this printout to them, can I get him for any violations of the HIPAA act? He violated my privacy by supplying the CA with very personal medical information and I feel like he should be punished in some way. Did I waive my right to privacy by requesting validation from the CA? Also, since the printout was just provided to the CA this means they had been verifying with the CRA's this whole time without any proof. Any suggestions? paw67 Posted August 11, 2003 Report Share Posted August 11, 2003 I believe that since you requested validation from the CA after this was already paid, then you did waive your rights, however, if the ca is verifying with cra's & not validating then you have them on violations. What exactly have you sent to the ca and was everything sent cmrrr? If you have a paper trail and can prove that they verified the tl with the cra's but didn't validate then I would send them and ITS letter and demand deletion or file suit.Good luck & keep us posted.paw67 Link to comment Share on other sites More sharing options...
