Anonymous Posted February 13, 2003 Report Share Posted February 13, 2003 I have been helping all of my friends validate lately, and many of the companies are not only NOT settling, they are moving the matter to civil court! I have tape recorded conversations with Computer Finance in which they state that they called me 20 times between thanksgiving and christmas!( this was the validation period by the way) so,we decide to take them to court- we ask for 3000 dollars( shoot for the stars)and then we try to settle for deletion +1000$.what do we get? they send us a contract stating that they will forgive the debt and delete it. no mention on resale at all! So, we didn't sign it and went to court.Computer finance didn't show-up but on the last day for them to appeal the default judgment, they did-using the reason that I used fraud to keep them from showing-because they assumed I would sign the contract.Oh, and their lawyer called and told me they were going to counter sue me for fraud.These guys are bad men,according to gateway computers my debt is owned by citibank. and according to citibank I have never owed them anything.So, what should I do? the basis of my suit was failure to delete and harassing phone calls.Is there ANY lawyers in Michigan who help people with these cases? LadynRed Posted February 13, 2003 Report Share Posted February 13, 2003 You might try finding a consumer protection lawyer at www.naca.net - that's what they do !...and.. somehow I cannot see how their 'assumption' that you would sign their contract could be construed as fraud. What a crock of crap that is. Did you ever tell them you INTENDED to sign ? If you did so, then reneged, THEN they might have a minute chance, but on an ASSUMPTION ?? I have contacted a lawyer at Edelman, Combs, and Latturner about Sherman Aquisitions and they are interested in my complaint. I told them I'm interested in taking action against them - so head on over the www.edcombs.com, to the Special tab and have a gander at the CA's they're looking to go after with class actions. They are in IL. and I am in MA. They are a great contact to find consumer law attorneys in your area! And if it is a good case they will take it. dunky Posted March 6, 2003 Report Share Posted March 6, 2003 I'm having some trouble with Sherman Acquistions as well, so I'd be interested in hearing about this class action suit. I'm even getting letters from NCO saying that they are using Sherman Acquisitons to collect on a debt that is not mine and was removed already from my reports.
