Hope this is where I can ask a question!!  I have followed C for years and she indirectly has helped me helped lots of folks!!

 

Ok, I have a lawsuit from an Attorney representing an actual hospital, he is not or does noy appear to be trying to collect for his firm. He sent a demand letter with a lawsuit printed out in it, I sent a validation letter which he responded to with a bill. He filed suit and i filed an answer, then filed discovery. he has answered them and asked for a telephonic hearing as he is in houston tx and the case is in collin county tx, far away.

1st Question?? what should i file to object to this to make it hard for him?? the lawsuit is for 1400.00

 

History- We had a baby and made an agreement with hospital and signed a contract for the amount 7500 which we were told included everything including the circumsicion procedure, it has been alomst two years and then we get a demand letter for the procedure we were told was included by a third party hopsital vendor. We have no contract with the third party vendor but the attorney is using the vendors contract with the hospital as why we owe. I have an email from the hospital staff that says they were unaware that procedures had changed right before we signed our contract with them. I also have a witness that was with me in hospital

 

2nd??  Any advise on some motions or steps??

My son is being sued by Portfolio recovery, I am helping him with this. I helped him with the answer and he filed it, he just received his court date and cannot make it. HIs employer will not give him time off, he may lose his job. Can he change the court date?

@ewise59, I'm not in NJ and I'm not a lawyer, but your son should be able to request a later court date.  You can check online for your specific court website for information, or call the court clerk and let them know what you want to do - they should be able to direct you to the correct information.

HELLO I WAS WONDERING IF SOMEONE WOULD BE ABLE TO HELP ME HERE. I'M TRYING TO HELP A FRIEND THAT IS BEING SUED BY A CAR LOT. MY PROBLEM HERE IS THE DUDE DOESN'T WANT TO FIGHT IT. HE WOULD RATHER SETTLE IN COURT AND SET UP MONTHLY PAYMENTS SO HE CAN THEN FILE BANKRUPT. MY PROBLEM IS I DO NOT KNOW HOW TO GO ABOUT THIS SINCE I ONLY KNOW HOW TO FIGHT THE DEBT. IS THERE A SPECIAL FORM THAT HE NEEDS TO FILL OUT OR SHOULD HE JUST LET THEM HAVE THE JUDGEMENT. HE DOESNT WANT TO HAVE HIS WAGES GARNISHED, BUT HE IS WILLING TO START MAKING PAYMENTS. CAN SOMEONE PLEASE HELP ME ON WHAT TO DO HERE. I'M COMPLETELY LOST WHEN IT COMES TO GIVING IN TO THE DEBT. THANK YOU FOR YOUR TIME.

@masa26_73 If he just wants to settle and make payments, even if he plans on BK later, it would be better not to have a judgement showing up on his credit.  He can call them and make payments with a request they dismiss the suit.
