k12503 Posted November 3, 2002 Report Share Posted November 3, 2002 I have sent NCO 3 debt validation letters to which they only send a compuuter printout of their fees and the debt the claim I owe. Have sent a letter to CRA asking them how they were able to validate debt from NCO as am still unable to. I am in Florida and contemplating suing as I have given NCO enough time to respond. They have not reported debt as being disputed are still trying to collect alleged debt and have continued racking up fees . Has anyne ever sued NCO and won? tac14033 Posted December 8, 2002 Report Share Posted December 8, 2002 I have sued NCO successfully on 2 seperate occassions this year and settled out of court both times for $1000.00 each.The second time was much easier as I already had the contact info to their lawyer.I contacted their lawyer directly about my pending lawsuit and that I wanted to be paid a certian amount or I would file my suit.Their attorney very much believed me since I had sued them earlier and settled. The attorney could not authorize a payment until a suit was filed and until then my dispute like my many other letters to NCO was referred back to them to investigate.I then called the attorney back and said..."Let me get this straight, you cannot settle for NCO and they will not pay until I actually file a suit against them??"He said..."Sadly, that is the case we can only settle suits for them."I then marched down to the court and filed my suit that very hour.I then faxed the attorney a copy of the filing.He called me back later that day and said..."Now I am in a position to settle, I said well now NCO just cost themselves an extra $500 bucks for their stupid ****"He had no qualms and we settled out of court that very same day. Got the check and release signed in 3 days from filing my suit!!I told him, I like NCO, I hope to do business in the future again soon! I haven't sent out my DV letter yet, but will this week. As I understand they NEVER validate, I may need to do as you did and sue them. I'd just LOVE to be in their files as persona non grata !! Anonymous Posted December 25, 2002 Report Share Posted December 25, 2002 I would write back that this does not constitute validation under the opinions of the FTC and case law. Tell them what they still need to do. Then state that until they do provide complete validation they are not able to try and collect on the debt. Tell them that the case law and the FTC have decided that placing information on your credit report before validating the debt is an attempt to collect the debt and a violation. Then tell them that you will be checking your credit report in 15 days and that any information about the collection needs to be removed by then or the debt validated.That is my personal opinion and not a verified fact of what has to be done.. I know that others have strung oput the process longer such as first letter, then one in 30 days, another at 60, then a final request at 90 days. Then they do the intent to sue after that. I haven't seen anything that required you to go through all of that but I could be wrong. georgiaboy Posted December 25, 2002 Report Share Posted December 25, 2002 Ron, the only reason some people "string it out" as you say is so that the CA cant come into court and claim clerical errors where involved and thats the reason they never received such and such, and thats the reason such and such wasnt sent.
