Wrong name on Credit report

My best friend is a "jr." 15 years ago his father went bankrupt lost his business - got taken away by the IRS. Since he has the same name as my friend except that my friend is the Jr. when credit searches are done his fathers info is pulled up. He has fought and fixed this for 15 years - he has gone to our State Congressman who said there are thousands of people with the same problem - consequently he can't get credit approval without a long drawn out ordeal - is there anything that can be done to fix this permanently? In the past the Big 3 have corrected the error only to have it return a few months later - Help Please

See these cases all the time, would say a strong 30% of files are mixed in some way with others information.

Here is a check list what may help:

1. Send in copy of drivers license (can blotch out the DL #). But they want clear pic of Jr. for their files. Request for them to unmix file and point out all info incorrect.

2. Add a consumer statement "Not to be confused with Sr. please verify all info before extending credit".

I don't know of any way to insure this don't happen again - heard the same thing from others that this is a life long fight on their part. Screening their credit report on a often basis to catch with files are re-mixed.

Only suggestion other than this sorry to say, is that your friend may seriously consider changing his name legaly. Then forwarding DL and the court form to CRA one last time for an update.

His Father has outstanding obligations to the tune of $400,000.00 to the IRS - this gets reported on his credit report. He has fixed it several times and it converts back to wrong info. He was told by an attorney that he could change his name but it was likely within a few years it would reappear under the new name . . .is that true? Thanks for your help!

Can happen to some people - but what I have listed should pervent this.

CRA's can place a buffer on the file to stop incorrect information from being reinserted. This is the most important part, that needs to be done.

Thanks for your help!! One more question before he tackles this hopefully for the last time - is there any recourse for the years of pain and agony this has caused. Basically he lives on a cash only basis has no debt, rents because it has been to hard to tackle the financing for buying a home etc. Her just got a credit card that he sent back the first time because they forgot the JR on the end of his name they reissued with the Jr added. Would it be best to go through the name change or tackle correcting as you suggested before going through the steps to change his name. Thanks very much! :D

Yes he can sue the CRA for negligence and compensation.

Someone else with legal background needs to answer this properly for you. Wait on the name change till you can see the whole picture step by step what needs to be done. Someone else will have better idea what should be done first on this part.
