CHARGE OFF DISPUTING ORIGINAL DATE

I was charged-off by the telephone company in June of 2001 almost

2 yrs ago.

The collection company is reporting my charge-off as of 8/2002

which is affecting my credit because it shows as a recent charge-off.

According to the FCRA a creditor must report the original charge-off date 30 days after it went into collections.

I have the following 2 questions:

1. Am I correct in disputing the Charge Off date?

2. How do I get the collection company to record the correct

date.

I have never had an account with XYZ PHONE CO. that charged off in August, 2002. Please delete this account as it is completely inaccurate.

Is the CA reporting 8/02 as charge off or the date they took over the account?

Not quite. They are required within 90 days of reporting the account, to inform the CRA of the month and year of the commencement of the delinquency that preceded the chargeoff. The 7 years starts 180 days after this month.

It doesn't matter if they're in collections, it's the original delinquency (with the OC) that sets the clock. A transfer to collections or payment to the collection agency doesn't reset the 7 years.
