double billing Dr bill driving me crazy

I have this issue with a Dr. whom i visited. He forgot (and this was from his own asst..) to submit the necessary forms to the insurance comp. Now he expects me to pay him for his mistake ..i have sent him letters stating that i paid my required $10 copay and that was all i had to do since he was a participating dr on my comp. insurance plan. He sends this IC systems collection agency after me and i try explaining to them the situation as well they dont care they want me to pay the 140 dollars the dr. says i fraudulently owe him. Now i cannot finalize a mortage or even get approved for home insurance because of this negative item on my credit report i am PI**ED off..I dont owe the money it was his fault or his assistants fault have them pay the 140 for not submitting the claim to the insurance comp. is there something that i can do? any help would be appreciated.

I will see IC Systems in court tomorrow, 8:30AM. I will let you know what happens. I'll post right after, ok? They are a bunch of numbskulls, I tell you. This was the one whose lawyer told me that they sent the collection letter to my current address back in '96 when I didn't move here until '00. Not only that, she claimed that they did show it as disputed and I have 3 months worth of credit reports to show that is not true. Can you say, "Momma's goin' shoppin'?"

They all dekleted already, but you know that they took forever and a day. My court date with Providian is on August 26. They will probably try and settle out of court, they all did. Only one was smart enough to offer me enough to settle, though. The deal weith Providian is that they ignored me until I threatened to sue. Then and only then did they open an investigation to find out what I was telling them all along: that it was a fraud account. Then they took their sweet time having the info deleted. So that's $2500 I'm suing for. And I am sure I'll get it. I wrote to them 4-5 times before they even answered me. I'll post after court tomorrow. Thanks again for all of the good wishes.

Well, they cases were dismissed because I got there 1 minute too late(I would have been there on time if it didn't take me 15 minutes to park and if they didn't move the courtroom to another builing due to construction, but regardless, I was late). So I have to file all over again. You are supposed to be there at 8:30, they give you no leeway AT ALL. I'm a single mother for Christ's sake. I guess it's time to hire the nanny, huh? I have never heard of that in my life. So now I have to go through this all over. I certainly hope that they did not think that I waw going to let it go. Oh, by the way, I think it might be a good thing. I can file $10,000 worth of charges on them now. One $5,000 case and two $2,500 cases. So maybe it was a blessing in disguise. I'll makeit so that I have to go to court 4 days in a row, even. One case per day if I break it down into four $2,500 cases. What do you think about that?

How exactly do i get in touch with the BBB or the minn Ag..

and how do you gt that 2500 amount? i would also like to know what i would have to do..and if i even have cause for a claim here? i know that people keep telling me that since the dr. bill is only for 140 that i cannot even go to small claims court for it. I had the lawyer that was working on my closing send the dr. a letter (although i dont even now if he is getting his mail since i think his asst the idiot who admitted they did not submit to the insurance compay may be intercepting the mail..)

any advice out there...im pissed that this is the only negative item on my credit report and its still keeping from getting something as simple as a freaking store credit card...whats the deal with that.

oh yeah while im venting "why is it that when company's make inquiries into your credit that lowers your credit score but in order for you to get some type cards or i have even noticed places like my long distnace phone company make inquiries into my credit therefore lowering my score therefore making it impossible to get a decent score ..so when you are trying to buy a house they tell you oh you have to many inquiries but let me check your credit to see if we can give you a loan.....its a stupid revolving door where you are set up to lose...

I don't have a whole lot a "hard" inquiries so I haven't been concentrating on that area of my report.

You are right. This credit and FICO stuff is a vicious cycle. I'm doing enough to qualify and purchase a home and then I am going to leisurely work my way up to 800 if I can.

The inquiries you see (soft) don't count, so don't sweat those.

If you don't recognize the hard inquiries, dispute them saying you never applied for credit with the bozos so they didn't have a "permissible purpose".

They should drop off at the 2 year point, so check the dates.

In Los Angeles you can file 2 claims for $5000 and as many for up to $2500 as you wish(but after 12 it's $35 to file, not $20). But as I think I've posted before, I've found a secret. You can say that they violated federal law AND state law(at least here in CA). So that's $2000 plus damages. And for an inquiry it's $2500 for CA and $1000 for federal. That's $3500. I am so glad I moved to Cali. So I am just breaking it up. In CA some sections it states very clearly that it's PER VIOLATION, so you CAN get more. I don't know whay the FTC can't get it clear for the FDCPA, but for those of us in CA it's a Godsend. I spoke to someone down in small claims and they said as long as you are not filing for the smae thing, you can file against a compnay over and over. So I broke it up into each violation. I'm considering filing one a week. When they are served every week, they might be more interested in settling. It's gonna cost to send someone out here every week and then fly her back The woman at Genesis told me she figured it would be $800 for them to send her out there and wanted to settle for that amount. So if they get served 4 times in 4 weeks(or more), just to send her out here would be $3200. A nice jumping off point, don't you think? Don't forget that you can sue them for up to 2 years (or is it one-I had a hard day). You have that right. Hell, I'm thinking about digging out all of the old companies that did me wrong since March. Remember that it is one or two years from the time that you discover the violation. So my new court date is September 6-at 1:30. There will be nothing that will keep me from being there at 1PM SHARP!!! I have a court date with Providian on August 26. I'm not missing that either. I need a shower. It's been a hard day.

3)Kalisto, try www.bbb.com. for the Better Business Bureau. I think the $2500 you saw is California state law. You might want to see if there is a similar law in your state.

4) Hey, smogtek, can I have dibs on helping you with your loan when you buy a house? I work for maybe the only mortgage broker in the world who actually tells the truth and puts the borrower's interests first.

I just wanted you to know that I received a letter from the Minnesota Attorney General in reference to the complaint I sent them about IC System. The AG's office contacted IC System and gave 10 days to get back to them. I think this will make things that much sweeter this time around in court. I was right. Everything happens for a reason. I also received a letter from the Florida Office of the Comptroller in response to a complaint that I sent them. It was in reference to a deleted account that they placed back on my report. They reported it by an unlicensed, unregistered, not-in-existance company. The Comptroller couldn't help me, but guess who they referred the account to? That's right, the FTC. I'm suing those bastards too. I have all of the evidence that the compnay is bogus. I am having so much fun. I can just sue people for a second job. Damn, these fools are stupid.

Do you have to wait a certain time before you can contact the DA? Im about ready to contact them myself. i have already send a letter to IC systems asking them to validate the debt and i had a lawyer send the dr. a letter (hoping to scare him into doing the RIGHT thing)

Do you mean the Attorney General? I am assuming that DA means District Attorney. How long has your situation been going on? It depends on how much they have done. That way your complaint holds more weight. I had a pound of evidence to send them. For ALL of the boneheaded CAs I have been dealing with. They might help with my lawsuits as well. It's their fault that they gave me so much to work with . Especially the dumb a$$ IC Systems lawyer. She dug their grave deeper than the 6 feet that it was already. I'm thinking about writing to her state bar association. Do you think it's overkill? I dunno. Maybe I'll wait until the week before the cae when she calls me again. HEE HEE HEE! One of my favorite words now is LEVERAGE.

P.S> The doctor has to answer to someone as far as his accoiunting goes. If his assistant is intercepting mail, I would go pay him a visit in person. Let him know that you believe it wasn't his fault, it was hers. And she is further making him culpable. It's her job. She gets paid for it. Let her<gasp> DO it!

IC System caved after I sicked the Minnesota AG onto them. To be fair, I did my homework and had sent the CRRR letters and documented everything, so when I asked the AG to look into, IC had to look bad!

As I remember, it was about 10 days start to finish. I called EQ yesterday to follow-up on the copy of the IC/AG letter I sent them and it has already been deleted and I've got the new report!
