equislee Posted February 3, 2003 Report Share Posted February 3, 2003 I was just sent to summons by certified mail from two different lawyers that represent two different credit cards both issued from citibank. I sent a debt settlement letter to the lawyers back in December but I quess they chose to ignore it. My husband has been unemployed since June and his last Fed. extension check will be in March. I am working a full time and a part time job and am using our 401 to pay off the creditors. My plan at this point is to call citibank directly and explain my situation and see if I can get them to drop the suit and work with me, since I really don't want to deal with the lawyers. equislee Posted February 4, 2003 Author Report Share Posted February 4, 2003 Thanks, I knew from reading all the great info on this site that I had to repond and respond in a timely manner. Actually I called citicorp this morning and they were not very helpful or nice and told me in no uncertain terms that citicorp was going to go through with the suit. Well to my surprise I called the lawyers and they were actually very nice and actually worked with me on a settlement and a payment plan and dropped the suit and said that if the payment due date didn't work for some reason in the future to call and set something else up. I don't know why they couldn't have replied to my letter way back in december this way. I still have one more lawyer to call ( I just got their anwering machine-I guess they are too busy suing people to answer their phones) hopefully they will be as easy to work with. If I hadn't wasted all my time with the CC Myvesta way back in September I wouldn't have to be going through this. But I am glad that this site exsists so I can learn from my own and others mistakes. equislee Posted February 4, 2003 Author Report Share Posted February 4, 2003 Ok, I just talked to the court to tell them that the lawyer and I had come to an agreement and they said that I needed a consent judgement or else it would go into default and would look bad on my credit report. She wasn't a lot of help most people I have ever dealt with at Shiawassee Court treat you like an idiot, but does anyone know what this means? The person at the lawyers office said they were going to send my the agreement in writing so I am going to wait for that to show up, before making any panic phone calls. lee Link to comment Share on other sites More sharing options...
IronMan Posted February 8, 2003 Report Share Posted February 8, 2003 No use dealing with the CC companies.Wait for the agreement and check it over CAREFULLY. Court won't drop case on their own. The attys have to file a Motion to Dismiss to the court, but won't do that until they get your signature on the agreement. Court clerks aren't supposed to advise you on what to do. All they can do is provide forms and answer basic questions.Make sure that you bargain for a positive "PAID AS AGREED" or if not, make damn sure it gets DELETED. It's not going to help you to bust your butt just to have it reported as a PAID COLLECTION. Screw that! NOTHING OTHER THAN THE TWO CAN BE ACCEPTABLE!!!!Good Luck. Anonymous Posted May 9, 2003 Report Share Posted May 9, 2003 I also just received a summons to appear in court in 2 weeks in NYC. I'm out of work and barely can make ends meet as it is. I called the attorneys for the plaintiff but they worked out a payment plan I can't afford at all. (I only owe $960 but they've attached more than $900 in interest as well.) I don't know what to do.
