dunky
do i have the right to get validation of a debt that is with a credit card company. The say that they don't have any information on me but they know they had enough to charge it off. NCO owns the account but they aren't reporting it, the bank is. I have sent two letters requesting validation and nobody has replied. Should I file an intent to sue? Do they have to validate? If not validate, don't they have to provide me with some kind of information on the account that they say is mine? Please help.
admin
Debt validation is for CAs only. However, if the OC is saying they have no information, why not try to dispute information about the listing with the CRAs?
dunky
i've done that but they keep saying verified. Its' like a viscious circle...
admin
You said you wrote to the OC and wanted to see proof that the account was charged off? And they just said "it's charged off"? If you haven't, then I would ask them for their proof - tell them you don't think the account is yours and want to see proof. As far as NCO - if you've requested validation and they are not reporting, you are done with them. I'd just sue them if they continue to try and collect. dunky
NCO is actualy not even reporting the debt. Cross Country Bank is although they sold it to NCO. Can they still report it if they sold it?
