Anonymous
Hello -- I am getting calls from a creditor every morning before 9AM. I read on your site that becuz of FDCPA, 3rd party debt collectors cannot call before 9AM. But does that hold true for the original credtior? I hope so, becuz the number of times they've violated this rule is about 20. (that'd be 20 x $1000 !!)
Swede
Unfortunately it's not $1000 per violation, but per action. The FDCPA doesn't apply to OC's collecting debts in their own name and, the FDCPA is the statute outlining when collectors can call. Hopefully I'm wrong but think you may be SOL. Check with your state laws as well.
