dave38
I have a satisfied judgement on my CR, but i was not served. My parents recieved the certified letter at their address. Anyway, the court says that i need to hire a lawyer to file a motion to vacate. any ideas? I thought i would have to go down and fill out a form or something. LadynRed
You don't necessarily need a lawyer, but you MUST get the correct forms and paperwork done properly if you do it yourself. Here's a a link that may help you get started. You need to look up local rules and procedures for your location.http://www.nwjustice.org/docs/3215.html
Anonymous
This week (Monday) I was successful in getting a judgement vacated. My situation was exactly like yours. Satisfied Judgement, Never served. I simply went to the courthouse myself and filed a motion to vacate the judgement(I live in Alabama). I did not have an attorney representing me. You will probably need proof that you lived elsewhere at the time the judgement was served. So start looking for old utility bills, lease agreements, car tag renewal forms, etc. Take as much info to court as you can find. Even if you have to ask the power company or an old landlord to give you copies of old bills or lease statements. I do not know what state you are in, but be absolutely sure that you need a lawyer to do this.
admin
What state are you in? Another suggestion is to call the county clerk again and see if you get a different person/answer. You are talking to government employees.
dave38
I'm in Ohio. I called the court again and did get a different person. they are pulling the records for me to go and look at. I also called the post off, but they said the have no records of it being sent or recieved because it is too old. I'm hoping to find proof that the certified letter was forwarded to a different address. maybe that would get them to listen
