michelle0916
I had 2 major collection accts which were removed from my credit reports thru the debt validation process. The CA was now purchased by another CA, NCO. They are now contacting me again regarding the debt which they failed to validate previously. Can I sue? I would think that they should have record of my previous request for validation and should know not to contact me. I stillhave the original letters and they have since contacted me twice for each acct. Is this an easy $4000?
admin
Hmmmmmm - my guess is that yes, they are in violation. But remember, I said guess. I'm not sure about the legal ramifications of one company taking over another, and what obligations they are required to keep of the company they bought. You could always just go debt validation with NCO, though admittedly, this is a pain. According to jordanmorgana, they never validate.
michelle0916
Actually I had a small collection account with NCO once and they actually sent me a hand signed letter apologizing for the info on my report and removed it. I am not sure if this new info is being reported though, haven't checked. My credit is now clean and don't want to have to start the DV process again.
