Mortgage being reported to CRA wrong?

Recommended Posts

I filed Chapter 7 BK in 1997 in FL. Mortgage was up to date and never late. Listed on the debtor's stmt of intent to be retained and reaffirmed. World Savings does not reaffirm (maybe because it was up to date?) Anyway, they have been reporting to CRA as Discharged in BK, 0 balance due. Contacted the FTC and they said to send certified letter to them. Did that. They said they are reporting correctly. Know of several other people who have filed and their mortg. is being reported with timely pymts. Am I wrong or am I being discriminated against? They send me stmts every month and take out the pymts from my checking acct every other week. Send me info all the time (aren't they not to contact me if I was discharged?) Are they violating something? CRA said this does not make sense. FTC said it doesn't sound right. But I can't get the mortg. company to correct it. What can I do? Isn't there a standard way all lenders (mortgage companies are supposed to report after a BK?) After all, you have no choice but to list them on the BK petition. Please HELP!!!

Personally, I would attack this from a different angle.

I would send letter to mortgage co CRRR with a copy of the CRA listings. I would point out that they are reporting 0 bal. Then get facitious.... "So, I take it that I have no balance and therefore my mortgage is clear. Please forward deed without lien encumbrance to my address at: 123 Main St, City, ST 11111. Thank you for your cooperation!"

That will throw them for a loop. They will write back that there is a balance, yadda yadda. You can then use this with all 3 CRAs to prove that the listing is inaccurate and was not discharged in BK!

Let them hang themselves!! :D

Guess what? I've already sent them a letter CRRR and to quote from my letter, "If we had been in bankruptcy why are we still in the house and you have not come after it and if we have a 0 balance then why are you still taking money from our checking account?" Their answer was that they have submitted all documentatin to the credit bureaus to reflect that a Chapter 7 BK was filed and discharged on December 30, 1997. I'm ready to pull my hair out. They were specifically listed as to be retained. Thanks for the suggestion, though.
