crzydmnd72
I posted in the main forum about some judgements appearing on my credit report. However I had a moment of clarity and realized that these are past the SOL here in Oklahoma (5 yrs) There are 3 judgements...2 that I KNOW were handled in bankruptcy from march of 1997. The 3rd one I do not recognize. I am awaiting a copy of my schedule of creditors (on its way) to tell me for sure. However..should I worry about these? They havent been renewed...the dates of last activity are all in 1997...2 in March 97 and one in Jan 97. My BK was discharged in july 1997.Am I truly free of these? I think one was Sears and one was a medical.TIA:)Glenn
ghacorp
SOL's and judgments no longer matter as your bk declaration nullified all dischargeable debts listed when you filed. Chapter 7 filings are reported for ten years whereas Chapter 13 filings are for seven years. Both filing records are actually available through the federal court (web pacer system) for a period of twenty years.
crzydmnd72
Thanks for the responseI got a copy of my BK..the judgements and 2 of the really bad items are included. All that is left are 3 medical collection accounts totaling less than 1000.00 and some INQ.sWhy does MEDCLR/Sterling have to report the same account 3 times with less than a dollars variance between all 3 reports?I will dispute all 3 since it seem THEY dont even know how much I owe LOLPammila....is KB9TBQ a radio callsign? just wondering. Thanks again:
crzydmnd72
Hi Pammila.Well I was a tech too..had to learn code tho LOL.I let my ticket lapse:(It is one account..reported from 3 different versions of Medclr. Although reading about Medclr here, I am not surprisedI believe its even paid in full...although I havent been able to lay my hands on payment proof yet.I will dispute these as not mine or paid...which would be better? Thanks:) and 73's LOL
crzydmnd72
well upon further reading into my BK and credit report..I have only 2 judgements..both were included in the BKjudgements and BK are all from 1997..so I have a little more time to go before they fall offI did fax dispute letters to the big 3 last nite..noting that those judgements should at least read "included in BK" otherwise the CU wants me to pay them off since currently they are showing unpaid and NOT included in BKThank you Pammila:)
crzydmnd72
Hi PammilaYes I did include the notation on the faxed letters that a mortgage loan was pending these items. However, I just realized I forgot to include my SSN on all the letters...I also didnt ask them to send the updates to the CU...should I refax the letters with this info or just let it ride? Thanks again:)
Anonymous
Easiest way to handle the judgements that were included in the BK is to file motion to vacate/set aside. I did this based on USC Title 11 Chapter 5 Subchapter II section 524. The title to the section is "Effect of Discharge". In this section is specifies that the judgements are rendered VOID. I stated the law and Websters definition of VOID. The judge set aside the judgement and I had them deleted from my bureaus!!
crzydmnd72
wow...now THATS a good idea:)I will certainly check into that. I do not live in the county anymore where they were filed but I would travel back for that:)
