collection law question

is there a law that states a time limit until a medical account can be turned over to collections? my daughter was in a residential medical center for 6months. they took her to a hospital for blood test on my "power of attorney" i got a statement from the hospital that did the blood work that said. "DO NOT PAY" the following month i got a bill for $220 and it said if it was not paid in ten days it would go to collection. i called them and told them they have not filed it with my insurance co. time went by i heard nothing from them. then months later i saw it on my credit report as a collection for $220. i called the CA and the told me all was paid except $20. i sent them a check for $20 that day. i called them to get this removed, however they refuse to do it. i told them that the $199 was my insurance responsability and that they never billed me for the remaining amount. they admit they never billed me for the balance after getting the insurance payment.they told me that i should have known how much i owed when i got the statement from my insurance co after they paid there portion. i told them they had interest on the bill and i didn't know. and thats why i called them when i did. to find out how much i owed. but they also sent it to collections 37days after the first due date. is that legal?

I have to comment on this. This had happened to me this past year. For some reason, the billing side of an office thinks you should pay when you receive your EOB from insurance. I raised so much H*** with the "place" about this that they ended up writing off the balance of the account. You have a right to receive an itemized bill showing all charges, insurance payments, adjustments, etc. from the provider. EOB's do not contain certain parts of the bill, such as, how many doses of ?????. I had another place who, after prodding, sent me a computer generated statement. This only covered department charges, which is not an itemized bill. I contacted the CEO of the "place" and again, balance written off, plus an apology for the inconvience. The main thing I said to them is "Do you pay your utilities bills every month without receiving an itemized statement for the services". DUH! From what I understand, some states require they do this. Check your own for that. Mine were only threats of collection. As for you, I would contact the OC manager, etc. and tell them the whole story from A to Z. Be sure to tell them about the CA and the way it was reported, such as, never updating to show any payment received. Be firm and professional as long as possible (at least try). I usually demand that the biggest boss in the building be put on the phone NOW. If you don't get satisfaction, be sure to tell them how unfair they are and to "Have a nice day". LOL!!!!

misery loves company. i'm disappointed in myself i didn't think to ask for higher up! hey! why didn't i think of that! your so right about the cob and them telling us we are to just send in a payment after looking at cob statement. when you make a charge on your credit card. do you mark it on your calendar wait 30days and just send it in without a bill! these people are a thorn in my side. thank-you, too bad its friday night. i'm primed to call them right now! either that or proform a little medical exam on them. bend over please! ouch
