Anonymous
i am planning on filing for bk but on the questionnaire i received it asks about being an officer of a company. i am, plus i also sign on the company checks and have a company credit card. does this make a difference. will they try and get the money that way. i do not want the company i work for, do not have any holdings in, to have to suffer bc of my bk. bw4444
I haven't gone through this, so this is just advice.Sometimes people try to ditch assets in corporations and trusts, and then file BK. You must follow a number of rules to obtain the benefits of these entities. Otherwise, if you are sloppy with them & comingle biz assets with personal assets & money, etc., they may disallow the corporation and take everything. However, if the corportion is legit, then you should have no problems.Personally, I wouldn't touch a BK without seeing a lawyer who specializes in BK. They would help you structure everything appropriately.
