bingo
Could you guys look at this case? Looks like it is against Wi. law to collect SOL debts. Has the case been appealed and, what is the signficance of an unreported case? TIA!http://www.kohnlaw.com/site_uploads/newsletter/newsletter10_2.pdf
calawyer
It is an unreported case so it would be really difficult to find out whether it has been appealed. Maybe you could email them and ask.
Swede
Damn bingo, this is a good find. It definately reads the way you're interpreting it- it'll be interesting to see what the outcome will be and how it'll affect the FDCPA. We'll have to have calawyer look for periodic updates..... might as well put him to work
bingo
Yeah, it'll help some folks for sure. I'm just wondering what the signficance {if any} is of an unreported case.

calawyer
In most STATE courts you can't cite unpublished trial or appellate court opinions. In Federal court it is OK. They are not binding though, and will have whatever persuasive weight the Court deems appropriate.
bingo
Calawyer,Thanks for your time! I did email Kohn law and will report if they respond. While I was on their website {www.kohnlaw.com} I did some prowling around and found this in their FAQ's.Statute of Limitations What is the statue of limitations on open account purchases in Wisconsin? The statute of limitations in Wisconsin on open account purchases is six years from either the last date of purchase, or the last payment date, whichever is later. Recent Wisconsin case law prohibits us from accepting and making demand on any claim out of statute. Again, thank you.
CyberDeeva
Hi everyone. I've been reading the board all week, and have loved the information I've been getting..particularly from calawyer and swede. My problem is with Wolpoff and Abramson and an old "voluntary" repo from Chrysler Financial. First of all, Chrysler duped me into repoing my car....I paid through the end of my lease, and thought they were coming to pick it up b/c I was turning it back in (they did not want to let me know refinance the bubble payment). I got a letter a week later saying they auctioned it and called it a repo. I was PO'd and planned to fight them on it, but didn't. Anyway, it went to court, and I didn't go. It ended up on my credit, and they sent it to Wolpoff and Abramson. W & A have attached my account 3 times. The judgement is listed on my credit twice for 2 different amounts. Once for Chrsyler, the other from Wolpoff and Abramson. I'm trying to get a mortgage loan, but no one will touch me b/c of that. I want to try and fix it by making a settlement arrangement of some sort, but I am scared to call W & A b/c anytime I do, they log the number and call and harrass me and my neighbors and then start going after my accounts. I have other little things on my credit, but that is the big one. I also just paid off another judgement for 837.55 for an old Bell Atlantic (now Verizon). How do I go about getting that one removed. How much will my scores (EQ 513, TU 587, EX 557) go up after those are removed? Helllllllpppp!
calawyer
I'm having a very busy Friday and I don't really have time to chase this one down, but I can tell you where to start. The Consumer Leasing Act (part of the Truth in Lending Act) regulates commercial leases. CyberDeeva
Thanks, calawyer. I will definitely start by reading the link. Do you think it would help or hurt to contact Chrysler? And what about it being on my credit twice, once from Chrysler and again from Wolpoff and Abramson. Any other suggestions?
calawyer
If you dispute, the cra's should delete one of the two duplicate entries. I would wait to contact Chrysler until you have done some more homework. Always better to go to battle with your gun loaded.
C Whitney
Don't know what area you live in Cyber but there should be a number (like *77) that you can dial before you dial any number. This will block the number you are calling from from showing up on caller ID. There is no cost for this service and you don't have to sign up for it or have caller ID for it to work. Check with your phone company. This can be used whenever you want to call someone and keep your number private. It is a one time thing and you have to dial the code every time you want the number you are calling from blocked.
