Rainbowspal
Maybe someone can answer this question for me??? My BF and I were hit with a judgment last summer, we now are trying to decide which way to go, small claims or Superior ct. to fight this can of worms. We are not married and we have been damaged separately. Can we file TWO court cases, one for him and one for me or(obviously in small claims, this would benefit us due to the $5,000 limit.) we are pretty confident with this case, I've spent the last 9-10 documenting etc. any ideas??? BTW we are in Calif. (and I do know there was an appeal time on this judgment, that we did not meet) Any ideas??
bingo
Before you file your own lawsuits, you need to get the judgment vacated. Normally, you have to appear in the court that granted the judgment to petition to have it vacated.
calawyer
Beg to differ but we don't have enough info to respond. What lawsuit are you wishing to file? How is it related to the case where a judgment was obtained? Is it one account for both of you or two accounts?
