ONEOFDWAGS Posted June 4, 2003 Report Share Posted June 4, 2003 Can someone tell me if I can use a restrictive endorsement on a creditor who I send payment to in AZ would work if I am in Texas and my Bank is in Texas, and Texas is one of the states that recognizes a Restrictive Endorsement but AZ does not. If you had to sue to enforce the "agreement" does the creditor have a registered agent in your state? If not I believe you would have to sue them in their state, AZ, and then it might not be enforcable. Also the creditor may have specific language in their agreement with you that pre-empts them from having to adhere to it unless agreed to in writing by an officer. An attorney has to answer this one.
