The CA tells me they can persue this for 10yrs, SOL in WA state on depts are 6yrs max. I really need an answer on this one, I'm suing in court & they (CA) counter suing for $$. Thanx for any help. Thanx for any help. </blockquote>Once a judgment is filed - the SOL is 10 years w/ 9% interest.depts? must be either a contract or promissary note - yes 6 years is the SOL. But that is mute with a judgment having been filed.Link is right above for statute of limitations for you to check. truckensafely Posted June 7, 2003 Author Report Share Posted June 7, 2003 They have yet to get a jugdment on this one, we are going to court next month. They filed a writ of garnishment on my bank account for this dept in the amount of $560.00 in which I filed an excemption because I was unemployed, they returned $500.00 & kept $60.00 but then I filed a small claims against them for garnishing an excempt account & they counter suing for more $$. In WA state, suing parties must attend mediation before it goes to court for trial, they want $1200.00 from me on the countersue. I mentioned the SOL is 6yrs & they said this is not a dept since the OC is the court where I live. They also told me that since is not a dept, they are not bound by coolection parctices governed by FDCPA. They threatened legal actions & followed on it makes it legal for them to do so.
