Tee Posted May 24, 2002 Report Share Posted May 24, 2002 I send a 2nd debt validation letter to a collection agency to verify that a debt was owed to pacific bell for a business ad after they didn't respond the first time. They have now responded with a "Financial Transaction Statement" which is just an account printout of what was billed and paid. They also sent a copy of the ad which I guess is what they had on file and shows a P.O. Box number on the ad matching mine and matching the P.O. Box on the computer printout. However, they provided no contract or signature.Have they validated? I'm not sure how to proceed/respond. I still don't know if they own the debt or if it was assigned. The next step according to the debt validation strategy on your site is: "If they haven't sent you satisfactory proof, send a copy of your receipt for your registered mail, a copy of the first letter you sent and a statement that they have not complied with the FDCPA and are now in violation of the act. Tellthem they need to immediately remove the collection listing from your credit report or you are going to file a lawsuit because they are in violation of the FDCPA, section 809 (."Well, I already did this in my 2nd letter to them when they didn't respond to the first. Should I now contact the credit bureaus saying they haven't verified? The letter you have to the bureaus is when the bureau has said they've verified when they havent'. Yes, now you need to a) send a letter to the collection agency telling them you intend to sue and send a dispute letter with the documentation showing the debt collection agency failed to validate, and therefore the listing should not be there.
