where to take to court

Recommended Posts

I'm past the second letter on my validations, even sent a third one. I'm in California so I believe they do not need to be licensed or bonded. Whatabout the CA in another state (Minnesota)? Do they need to be licensed in MN? Anyhow, I filed complaints to the BBB on both the out of state and in state CAs. Still nothing, so need to start filing lawsuits. Just not sure about where to go since one is out of my county and the other out of the state.

You did not say whether your debt was validated or not. If you are on your third letter, it should have been one stating they will be sued since they are in violation of the FDCRPA!

The steps outlined in the debt validation section are pretty clear.

Guys on the board, any other suggestions for howser56?

All help will be appreciated! :)

If the CA is out of state, most likely they have what is called a registered agent in your state. The link "Find Creditor Address" above has a registered agent list. As long as the company has a registered agent in your state, you can file in your state, you don't have to sue them in theirs.

howser,

I'm in CA and have filed a small claims suit recently.

The court you file in is determined by where your damage occurred.

In the case of credit reports, since you receive them at your home or PO Box, you use that zip code. The zip code determines the court you file in.

At least that's the way it goes in LA County.

If you're in LA try www.lasuperiorcourt.org
