LadynRed Posted October 24, 2002 Report Share Posted October 24, 2002 I sent a validation demand letter to Account Solutions Group (ASG) who is acting on a Household Bank (Best Buy) collection. I sent my validation demand letter on or about July 12th and the green card came back signed and stamped as received on July 15th. I have NOT received ANY validation from these scumbags. However, in yesterday's mail I DID receive yet another letter from them offering to settle for about 50% of the total.I interpret this as a violation, am I right ? They have NOT validated, yet they are sending me letters to further collection ?!What's my next move ? Can I threaten to sue them for violations of the FDCPA ?? The dumb thing is, I'm STILL getting statements from BestBuy, which I don't understand. By banking laws, this account should have been written off at least 2 months ago ! The thing that worries me is that Best Buy/HHLD is STILL sending me statements and I KNOW this account has to have been charged off, even though I have nothing in writing from them indicating this. So far, all the other creditors that have charged-off accounts have sent notification of when it will be done, but not HHLD. Will this have an impact on my validation demand to the CA ? Should I still send the 2nd validation letter to AGS ? This account is 'fresh' this year, I'm well within the SOL, but I have no idea how aggressive HHLD is with lawsuits. admin Posted October 30, 2002 Report Share Posted October 30, 2002 That's kinda weird. Why don't you call up HHLD and find out what's going on. Calling an OC is totally different than calling an CA - don't worry about doing it. Just remember that everything you say is written down and put into your file - so if you intend to say that this debt is not yours at any time in the future, don't admit the account is yours. I don't like talking to any of them, all you get on the phone is a customer service 'drone' who only seems to be able to answer questions if its in their script for handling calls. I'm not sure I'd be disputing it as 'not mine', but its early in the game.FYI.. ANOTHER CA called me yesterday !! I wasn't home, I never am, so they left a message on my pc answering 'machine'. The "law offices of xxxxxxxx".. this one is for Victoria's Secret, and I sent them a DV letter on the same date as the AGS letter, also recieved the green card back about the same date. The new collector on this Household (BestBuy) account is United Recovery Systems. Geez.. this is going to get tedious....AND, the last statement from BestBuy was dated 10/19. Letter from URSI is dated 11/11, so maybe the OC is finally going to stop sending statements ?? We'll see..... LadynRed Posted December 6, 2002 Author Report Share Posted December 6, 2002 Well.. figure this one out folks !I pulled my CR's last week and this BestBuy account shows as a charge-off.. finally ! I got a letter from HHB saying they were going to charge it off in Nov and send it to collections.. which they did. On top of that, the 180-day charge-off requirement passed several months ago, I can count 180 days from Jan 2002 (when I last paid), and its doesn't stretch to November !!! How can they do that ?Today, I get a STATEMENT in the mail from BestBuy/HHB !! How do they do that and why would they even bother ??? So, they've charged it off as a bad debt but they're still billing me directly AND I'm getting letters from a CA ?? How does THAT work ??? admin Posted December 6, 2002 Report Share Posted December 6, 2002 I've finally figured out the answer to the chargeoff/get the tax write-off/then pursue monetary collection activities.Apparently, if you collect on an old charged off account, you report as income for the current year in which money was collected: your tax benefit minus the income received.
