Anonymous Posted October 28, 2002 Report Share Posted October 28, 2002 I've sent two letters to the collection agency. The first was the request for debt validation, and was ignored for 30 days. The second was a demand to have the reference removed from my credit report, and intent to sue....and was also ignored. Both letters were sent via certified mail, and I have received the return receipts.I also sent a letter to Experian, and argued with them on the phone with a threat to sue, and they will not remove the credit reference because Experian claims that the collection agency validated the debt to them.What do I need to do now? I've already threatened both the collection agency and Experian with law suits. The collection agency fails to even address the situation with me. Do I really need to take them to small claims court? Wyndo Posted October 29, 2002 Report Share Posted October 29, 2002 It doesn't matter what the debt is for -- its mere existence on your credit report will severly drop your score. I think you should sue. The collection agency doesn't have to validate the debt, but if they don't, they must remove it from your credit report. If you ask for this information they must provide it. If experian tells you that the CA provided your name, address, and SSN, well this is not validating the debt. Anyone can provide this info.
