A brief rundown:

My PCR was mixed up with another individual

who at one time had the same name as mine,

as a result I ended up with a collection account that is not mine, but will not go

away. After I disputed this item on my report

I get a collection letter from the company

who now tells me they bought the debt from the OC,(a mailorder firm who specialized in

catalog sales).

I send a validation request and receive just the name of the OC and a brief order history

with my previous address on it, which could easily have been taken from my credit report

as was my current address.

Clearly they are unable to provide me with a

contract or detailed account history as they

claim what they sent was the only information

they have about the account and the OC is no

longer in operation, so they cannot obtain further details.

I think they assume they have validated, what

is my next step to get this item removed?

That is not debt validation. In fact, that is not even close to debt validation.

And you are right, that outfit will assume that it has valiated your debt and fully complied with the law.

It hasn't and you must take full advantage of the crap they sent you.

And you are also correct in that all they did was a copy and paste from your credit report. Anybody can do that which is why federal law demands genuine proof that a debt does belong to you.

For the time being, that letter is gold. So are the green cards that you used to send certified letters for your debt validation.

Forward a copy of that letter to the CRAs. And also state in you letter that the supporting documentation that the CA sent you clearly demonstrates that this outfit is unable to authentically prove that this debt does indeed belong to you since they have refused to provide the following:

• Copies of a signed contract or an instrument bearing my signature.

• Documentation verifying that I did in fact have an outstanding balance from this account.

• An explanation on how a calculation was made on what I purportedly owed.

• An explanation of the procedures used to inform me of such an outstanding balance.

Keep hammering away at the CRAs with this approach. All of them will not delete right away but you definitely have the proof and the law on your side.

It is a small world when I find that another person with the same exact name as me lives on Earth! If it were “Smith” or “Jones” or likewise it would not be surprising, but my name is unique. I have suspected for a couple of years that several of my alleged credit debts are in fact that other person’s and not mine. In fact I know very well none of the so-called CRA negative reports are mine since I have no memory nor records of any of the accounts in question. This other person’s bad credit history must have followed him to his son or daughter because I got a letter from Crapital One advising me of a deal to transfer several thousand in charge-off debt to a new credit card. The letter was addressed to the other person’s son or daughter at my address. Problem is, I only had two Crapital One accounts for a brief time and both were paid in full then closed years ago, per CRA and records.

I sent three CA’s validation requests, plus follow-ups, and they keep transferring the account off to another bottom feeding, scum sucking part of their Collect America gang of criminal liars. I just cannot get rid of these maggots but even if the account was mine the SOL elapsed many years ago and they have never replied to a DV nor sent anything on this bogus account. I even dared them to sue me! I would love to get them in court.

So, I sent the letter from Crapital One to the other's son or daughter at the correct address and e-mailed that other person with my name that I would sue them if they did not stop screwing my credit up! I’m sure they are remotely related to me several generations ago. That would be funny: I.P. Freely vs I.P. Freely!
