sueing collection agencies

Recommended Posts

I've sent the proper letters of validation to the collention agencies, and while 3 came back saying they would remove the accounts, 3 agencies did not respond at all. I no longer live that state (where the agencies are) what state do I file my claim (small claims court)in? Can I file in the state that I currently reside in?

Typically, you need to file in the state where the collection agency is. I'd call the country in where you live and see what they have to say. Small claims procedures not only vary by the state but by the county. If you can't sue the CA's then I'd move on to insisting that the credit bureaus remove the listings since you haven't been able to get them to validate the listings.
