update on validation

Ok, this is starting to get really interesting! Sent out original DV letter in oct, the CA then called about 2 weeks later, took the call by mistake, but was told they never recd. Ok sent copy of letter with new letter in Nov they recd. for sure(certified). Recvd. call in 1st wk of Jan from new collection agency saying they were assigned to collect on Dec 30. Argued with the idiot CA and told him to contact me in writing. 2 weeks go by and just got a message from the first CA to call them right away. My question is this, is the first CA still in violation of FDCPA since they never validated? Just curious, because it seems as though they transferred to another agency, now transferred back to the first one. Should I treat this as if they contacted me for the first time, or do I now proceed as if they have ignored the first two letters? Also how do you document a violation, just write down name, number, time and date? They spoke to my wife, and she took down all the information. I want to make sure I keep good records on this in the event I need to go to court! Please help! :(

You were perfectly clear. I would not treat it as a NEW CA. I would continue and send them a 2nd letter (click on Debt Validation link above)and go from there.

Yes, document all the telephone calls by writing them down. If you have a recorder or Caller I.D. use that also. Did you send them a C&D along with that violation? If not, do that right away. You don't want to talk to them. Every communication with them must be in writing so that you can build your paper trail in case you end up taking them to court. :p
