paw67 Posted June 4, 2003 Report Share Posted June 4, 2003 Ok, disputed CA tl (local cable company)with EQ and it came back verified and the balance went from $375 down to $75 so I sent DV letter. Received letter today (they also sent it CMRRR) saying that they received the request and contacted their client. The OC is not the same because the original company was bought out at least 2 or 3 times that I can remember. Anyway, the letter claims that the current balance is $420 and states that it includes a charge for unreturned equipment. The letter goes on to say that if this account was fraudulently opened they would like us to provide a police report and also provide documentation in the form of a lease or utility bill for 1997 (yea right, like I keep all of my old utility bills). My question is, I know that this isn't validation at all so should I send a letter saying thanks for responding but this isn't proper validation? Or, since they clearly say in the letter that this was given to them in March of 97, should I just send them an SOL letter, since in my state the SOL on open contracts is 6 years and this would be past that time? Also, is there a violation since when they verified it they verified it incorrectly and I have proof now with the letter they sent me showing the balance?Thankspaw67 Link to comment Share on other sites More sharing options...

I have read and re-read the letter several times just to make sure and there isn't any mention of ID theft/fraud. They didn't even send anything from the OC, they just typed up a letter with the balance and date they received the account from the OC. The only thing that they did provide was the address that the service was setup at (still current address0 and the last 4 digits of the ssn# used to open the account.paw67 Link to comment Share on other sites More sharing options...

I sent them a DV since I'm fairly sure the collection wasn't mine, though it is paid. I paid it back before I knew to 'question' the almighty CRA.They sent me a letter via CMRRR asking for a police report of identity theft or affidavit of such. They provided an email address to contact the person who sent me the letter. Ok, so I bite. I reply and tell them I never claimed this was indentity theft, simply that I have no knowledge of the account. ALSO that I had contacted the OC, and that they don't show that account associated with me so please provide me validation this is mine or remove it from my credit report.That was 2 days ago. lisak72 Posted June 6, 2003 Report Share Posted June 6, 2003 There are a couple of good reference lawsuits I like to include in my DV letters...one is adding the Brennan vs. Spears referenced in the DV section above...actually spelling out what is considered to be "validation" of the debt...what is acceptable, what is not. I would put those in your next letter, showing them the error of their ways. This is not even partial validation. A listing in their computer is not good enough. They must get documentation and if they are unable to provide this documentation, they need to stop trying to collect on this and remove their TL from the CRA.I don't think I would even bring up the SOL yet...save that for if they show you actual proof. If you don't have proper validation and don't have records on this yourself, then you really can't back up the claim of SOL is expired.Just my thoughts!
