I received a letter in the mail the standard we are going to proceed with judgment, garnishment etc. The letter had letter head as lawyer but at the bottom said this is an attempt to collect debt etc. I would like to settle this account but am unsure how to do it. It is a Circuit City credit card and has already been charged off. Who do I contact? Oc or CA? I also have 2 Cap1 cards that I would like to settle but that have also been charged off. I have heard Cap1 is hard to work with. Any suggestions. Should I just sed them a letter offering to settle or ask to validate (which they will) and then offer to settle? Thanks so much for help!! :)

The OC may be willing to work with you, but will usually refer you to the CA. You can try and find out what kind of settlement the CA is willing to go for. From here on out, however, do all of this in writing with them. Even send them a C&D letter which allows them to contact you via USPS only.

50% is good. However, when was this debt charged-off? What is the SOL? Is it past it? Etc.

The Cap 1 cards were charged off in Feb. I think the Sol is 3 years in Texas. I have not contacted them at all I am scared to death of putting my foot in my mouth. They have only sent letters. Frankly they are intimidating enough. So basically I write back saying I will settle but they must remove neg. info. completely from CR and state paid as agreed or what?
