:mad: I contacted TU by phone. I asked their rep why have they not reinserted FNBM. FNBM has sent 2 UDFs showing Pays as agreed/never late. TU says that they never responded to my original dispute and unless they put this info on a dispute response form, they will not reinsert!

I checked with them about the tax lien as well. Both EQ and TU state that they will start the 7 yr clock from date of release (5/2002) instead of date of payment (6/1995). I called The St of CO and they will not back date the release. (This was a paperwork screw up.)

I will *have* to sue them to get them to comply. I know that I can win in court. TU has a local Ph # so they probably have a local place to serve. How do I serve EQ when I am in SC?

If you do sue, many business entities have "registered agents for service of process". You should be able to serve Equifax in your state. Look up SC, Here is a link you can use to find out who they are:

So I have typed in a few names in the box for NY and I'm not sure what I'm looking for. Could you help me? I have 3 CA's I may need to sue and so far I'm not sure if they are even allowed to collect from me in my state or have a office here. Thanks

SCMom: I was just reading the FCRA looking for something else, when I came across a section that might interest you. It says here that paid tax liens can only be reported for 7 years from the date of payment -- it doesn't mention anything about the release date. So Equifax and TU are in violation. As jordanmorganusa would say, "Can you say cha-ching, boys and girls? I knew you could :D " Damn, I forgot to get the section, paragraph, subsection, subparagraph ad nauseum, hang on a second and I will look it up -- ok, here it is: 605(a)(3)

That is interesting... What is to stop a creditor/collection agency about not reporting the accurated date of last payment or delinquency or EVEN a charge off to a CRA? No wonder that whole 7 year thing needs to be constantly protected... another bad thing about CA's and the like, they want to extend that date as much as they can get away with... that is their leverage. they want money and any way they can threaten to get it, they will.. because eventually we will catch on that it is on our report, right?

</blockquote> Call FNBM, and explain the reinsertion issue with them. Say that the missing info needs to be reinserted back into your TU report. If FNBM does not reinsert, threated to cancell your account, and get one to where you were offered a lower rate. I had the same happen with another card, I threatened to leave them, if the item wasn't reinserted, and next day, it was back on my credit report:D
