Wards/bal 0/past due 60

Disputed with EQ, wards, not showing dates of lates. Came back with lates still there, now no dates showing, also went from R1 to R3. Shows balance zero (paid off 9/99), current status - past due 60 days. How is this correct, no balance yet past due? Disputed with EQ twice in the last two weeks, came back as verified both times. Any suggestions?

This account was never late because because I had made arrangements on an unknown date with an imaginary bank to send payment to the creditor before I went on vacation to the Moon. Please remove this.

So everyones suggests fighting this with the CRA?

I composed a letter to Wards, telling them that "per the California Fair Debt Collection Practices Act I disputed the accuracy of this

account and expected it to be reported as suchs." When I had spoken to them on the phone they said to send them a copy of my credit report, to see how they are reporting it. I also wrote: "Does his statement mean that your company does not know what it is reporting? Yet, when disputed directly with

the credit reporting agency, it comes back as correct. I will not send you a copy of my credit report. Your company should already know how you are reporting it...Again, I dispute this account and I am pointing out your mistake: reporting an account with a zero balance (paid in full as of

9/1999) as currently past due sixty days is not 100% accurate, if it cannot be reported accurately it is to be deleted."

Monkey Wards itself may be gone, but all accounts were sold to other companies - mine ended up with Wal-Mart !! So, as you said, someone is verifying and its probably the new owners.

Request the CRA send you the detials of HOW they verified - you're entitled to this information.

Earlier today spoke with rep at EQ, disputed again, no dates of lates, how can it be currently past due if no balance. The rep said it can say that if at the time of payment it was past due. But the way it reads that is the current status. This little item when in dispute raises my score by 40 points, so the way it is worded makes a big difference. Hoping to catch wards in a mistake by not reporting dispute. In Calif. OC are treated the same as CA in alot of respects.

§ 609. Disclosures to consumers [15 U.S.C. § 1681g]

(a) Information on file; sources; report recipients. Every consumer reporting agency shall, upon request, and subject to 610(a)(1) [§ 1681h], clearly and accurately disclose to the consumer:

(4) The dates, original payees, and amounts of any checks upon which is based any adverse characterization of the consumer, included in the file at the time of the disclosure.

§ 603. Definitions; rules of construction [15 U.S.C. § 1681a]

(k) Adverse action.

(1) Actions included. The term "adverse action" (B) means

(iv) an action taken or determination that is

(II) adverse to the interests of the consumer.

According to Merriam Webster, the definition of "date" is the following:

I would think that late pays are adverse to the consumer and since the FCRA states the the CRA must furnish the dates upon request which the definition of date being a specified time, I think EQ is FULL OF ****. They do this to me too and I'm over it....

Swede what are you going to do about EQ?

Received a letter from Monogram Credit Card Bank of Georgia today. They are handling the Wards account. They say they "have reported accurate information." Also wrote "if we do not hear from you we will trust that you are acknowledging agreement with the response above." Guess I'll be sending them a letter later today. I expect them to comply with Calif. law.
