Equifax refusing to investigate

I just received one of those "We will not investigate already disputed items" letters. This followed on the heels of their receiving a dispute and reinvestigaton request about a tradeline.

Eqifax had investigted the dispute ansd replied that the item was "UNVERIFIABLE" However they added the account back to the credit report saying that the creditor has 'updated the payig history on the account'

I sent them a letter to reinvestigate as it was inconceivable thatey they update n account that they considered unverifiable.

Now they send me a 'kiss off' letter saying they won't reinvestigate. What do I do?

Would dispute again; sending copy back of their own letter asking how can they verify if they just said unverifiable! That you want to know the process of their investigation and the contact info for the creditor to which you are disputing.

If they come back with one of these letters again, tell them your intent to sue, if they don't either verify positively or delete the said accounts. You then have you choice if you want to file a small claims judgment against them, you must make sure to serve them. And give a chance 1st for them to resolve the issue.

not sure if this will help. from what i read you stated it was already disputed. i found out from tu that they will not dispute for the same reason. The Fair Credit Reporting Act does require credit reporting agencies (CRA)

to investigate consumer disputes however, the law also gives them the right

to deny a dispute on the grounds that it is a duplicate request that has

already been proven, or if they determine your dispute to be frivolous (a

very vague term). so try disputing on a different reason for the dispute.

why do we have to reinvestigate reinsertions? i had this happen to me as well. a trade line was deleted and then appeared back on my report. i though they had to inform you in writting in five days if they were reinserting or it was a violation? i sent them proof. but its still there?

They do, if you did not receive this you need to write back informing them that you had not be notified of the reinsertion and are demanding that they now delete the item being disputed.

Give another try to inform them that they have violated your rights by not informing you of the reinsertion. They should comply & delete.

I sent 1st letter to Experian, the Initial letter shown on the Sample Letters linked to this site. Experian replied saying, they cant investigate, for me to resubmit with something like Not Mine, never late, etc. Should I have sent the other initial letter saying why I disputed the item?

Sorry I am not familiar with the letters used.

But if you fill in a bit more detail on the account, might see something overlooked that can be tried with the CRA or have a direct method for a certain type of problem.

What type of account is it?

What is it reporting that is negative?

What did you dispute the first time?

What are you trying to accomplish on the reporting?

The letter I sent said to credit bureau: You have inaccurate information on my report please verify and delete the following from the report as soon as possible. The accounts were listed as past due, collect, and 1 repo (which isn't possible cause I traded the car in before the repo date on the report!)

They wrote back and said: "We are unable to process your request. If you believe an item on your report is inaccurate or incomplete notify us. Be sure to indicate the specific item and explain why for example: "not mine, paid in full", never late, etc.

The next paragraph suggests you go to their website and "Request an investigation".

I requested they verify the account and they wrote back that they can't unless I am very specific about the reason.

Would suggest that you contact the creditor directly in this matter - if you don't have the address, ask the CRA to provide you with the creditors address.

Let the creditor know about their error in reporting the car as repo, when you in fact traded the car in. Also let them know that you would like to recieve a letter confirming this and that they will be updating the CRAs from there end.

This way you save a good tradeline - once they get it updated correctly.
