123rich
I diputed a file that Exerian has on my file for the second time. They responded with this letter..According to the Fair Credit Reporting Act (FCRA), a consumer reporting agency's role in the dispute process is to investigate the information to determine the accuracy and completeness of any disputed item by contacting the source of the disputed information and informing them of all relevant information regardin the consumer's disputes. If the issue is not resolved, then the consumer reporting agency must offer to include a consumer statement on the personal credit report. The Federal Trade Commission (the government agency cahrged with enforcment of the FCRA) does not require that the consumer reporting agency obtain documentation such as the actual signed sales slips, signiture cards, contracts. etc; nore does it require that consumer reporting agencies act as mediators or negotiators in account disputes. We are responding in account disputes. We are responding to your request to verify an item on your personal credit report. We have already investigated this information. If you still believe the item is inaccurate, then we can add a statement of continued dispute to your credit grantor. Potentially negative information, such as missed or late payments, and most public record items remain on the credit report for 7 years, with the exception of Chapters 7, 11 and 12 Bankruptcies, which remain for 10 years and unpaid tax liens which remain for 15 years. When you question information on your personal credit report and tell us specifically why you believe the information is inaccurate or incomplete, we contact the source of the information directly by telephone, letter, or through an automated verification system. We ask the source to check their records to verify blah blah blah.......What does all that mean?? They just refuse to reinvestigate the file.. What can I do about this? kb9tbq
They are saying that they will not negotiate with the creditor on resolving your problem nor will they handle debt validation. The creditor verified said information, but if you want you can add a consumer statement to your file stating exactly what your side in the matter is. Ravenous Wolf
That is a "go screw off letter" from Experian.I get those all the time once Experian verifies a dispute or if you ask them to further investigate an item. After sending numerous letters to Experian and talking to them on the phone, I have come to realize that they are not going to do anything more than confirm the existance of the credit information from the OC or CA. Experian is not going to go looking for proof of the accuracy of your dispute other than having the OC or CA confirm it in their own computers.I have now changed my tactics. I am going to provide PROOF to Experian.Every situation has some sort of technicality and it is up to you to exploit it.I have a PAID state tax lien. On the original lien, it has an address that Experian does not have on me. On the Release of the Lien, it has an address that Experian has of me.I made copies of both documents and included them in my dispute to Experian. I explained to them that the original lien has an inaccurate address and therefore needs to be deleted (and I gave additional reasons about incorrect information). That is a technicality but it is still proof and I am going to keep exploiting it in many different and creative ways until I can get it removed. That might be an avenue for you to pursue. Validate or locate copies of the original documents and then mail it to Experian demonstrating something inaccurate or incomplete.
Anonymous
I just got 1st letter from Experian. I wrote generic letter saying please investigate, there is an error. "They wrote back saying they are unable to process your request." If I velieve the info is inaccurate, to include the description in my request. They did not investigate anything. What did I do wrong. Was I suppose to start with the letter saying this isn't mine? I thought I was suppose to write the generic something is wrong letter first. Please help. L
BEBE, you would have wanted to send a letter or dispute online that there is not knowledge of account or account not mine. Then if it does come back verified you can try other disputes... [Edit by L on Wednesday, February 19, 2003 @ 02:37 PM]
